Can a RERA-Registered Project Still Have a Land Dispute? Madras High Court Explains

RERA registration is not proof of clear title.

A recent Madras High Court case from Thiruneermalai, Tambaram taluk, involved a dispute between N. Balakrishnan and S. Anandhan over the ownership and development of a parcel of land.

The case is important because it explains one clear point: TNRERA registration does not finally decide who owns disputed land.

The Case Details

Balakrishnan claimed that the property belonged to him. He said that his father had purchased the land and that he later inherited it.

Anandhan claimed rights over the same property and wanted to develop it as a housing project.

Anandhan had already filed a civil case against Balakrishnan, seeking an injunction to prevent him from interfering with the property. The civil court granted an interim injunction in Anandhan’s favour while the ownership dispute remained pending.

While this dispute was continuing, Anandhan obtained approval and registered a housing project with the Tamil Nadu Real Estate Regulatory Authority, or TNRERA.

Balakrishnan objected to the registration. He argued that:

  • He was the actual owner of the land.
  • A civil case and injunction were already pending.
  • The dispute should have been disclosed to TNRERA.
  • TNRERA should not have registered the project without considering his objection.
  • The project registration should therefore be cancelled.

Balakrishnan approached the Madras High Court after TNRERA refused to cancel the registration.

Why did the High Court refuse to cancel the registration?

The Court examined the difference between the powers of TNRERA and a civil court.

Under Section 4(2)(l) of the RERA Act, a promoter must declare that the promoter has legal title to the land and that the land is free from encumbrances. TNRERA can examine these declarations.

If it is clear from the documents that the promoter has no title or that the land has a serious encumbrance, TNRERA can refuse registration.

However, the Court said that TNRERA cannot conduct a full trial to decide which person is the true owner when both sides produce competing claims.

That requires examination of:

  • Sale deeds and parent documents
  • Inheritance claims
  • Revenue records
  • Possession
  • Witnesses and evidence
  • Earlier court proceedings
  • The validity of competing title documents

These are matters for a competent civil court, not for the RERA Authority.

What supported Anandhan’s case at that stage?

The High Court noted that:

  • Anandhan had already approached the civil court.
  • The civil court had found a prima facie case in his favour.
  • An interim injunction was operating against Balakrishnan.
  • Balakrishnan’s ownership claim had not yet been finally established by a civil court.
  • The project was already registered and construction had reached an advanced stage.

Because of these circumstances, the High Court held that this was not a case where TNRERA was required to cancel the registration.

The Court did not finally declare Anandhan to be the owner. It only held that the ownership dispute must continue before the civil court.

What remedy was left open to Balakrishnan?

The High Court allowed Balakrishnan to continue pursuing his claim before the civil court.

He could:

  • Contest the pending civil case
  • File a counter-claim
  • Seek appropriate relief in the same proceedings
  • File separate civil proceedings, if legally advised

The Court made it clear that TNRERA registration would not prevent him from pursuing his ownership claim before the proper forum.

What does this judgement mean for buyers?

This judgement does not mean that every RERA-registered project has a title problem.

It means that RERA registration alone is not proof that no ownership dispute exists.

A buyer should not rely only on:

  • TNRERA registration
  • Planning permission
  • Patta
  • Promoter statements
  • Project advertisements

Before booking a property, buyers should check the complete title chain, Encumbrance Certificate, pending litigation, injunctions, survey details and the promoter’s legal rights over the land.

Key takeaway

TNRERA can check whether a promoter appears to have title and whether the land has obvious encumbrances. But it cannot decide a genuine dispute between two persons claiming ownership.

In the Balakrishnan-Anandhan dispute, the High Court kept the TNRERA registration undisturbed because the civil court had already found a prima facie case in Anandhan’s favour and the ownership issue was still pending before the civil court.

The final answer to the ownership dispute must come from the civil court.
