What Is Transfer of Development Rights (TDR)?

Transfer of Development Rights (TDR) is a planning mechanism used by the Chennai Metropolitan Development Authority (CMDA) to acquire private land needed for public projects—such as road widening, infrastructure corridors, or transport upgrades—without paying direct cash compensation. Instead of money, the landowner receives additional building rights (FSI) that can be used on the same property, another property, or transferred to someone else through a Development Rights Certificate (DRC).


When Does TDR Apply?

TDR applies when a property is partly or fully affected by proposals in the Master Plan, Detailed Development Plan (DDP), or notified infrastructure projects. If only part of the land is required, CMDA will approve construction on the remaining land only after the affected portion is surrendered through a registered gift deed.

In cases where no construction application exists, CMDA may still notify projects like road widening and allow owners to voluntarily surrender land in exchange for TDR.


Does Existing Development Block TDR?

No. Even if the site already has construction—whether authorised or unauthorised—the land surrendered for public use remains eligible for TDR. However, unauthorised buildings do not become legal automatically. They continue to be unauthorised unless regularised or demolished through proper legal procedures.


Special Protection for Very Old Buildings

CMDA allows an exception for very old buildings when land is surrendered for a public purpose. If a property owner gives up part of their land for road widening or any public project and, only because of that surrender, the remaining building ends up violating rules like setback or FSI, CMDA will treat the building as legally compliant by default—but only if that building existed before 05-08-1975. This protection is strictly conditional: the owner cannot add floors, modify the structure, or change the building’s use.


How Is TDR FSI Calculated?

FSI credit under TDR is calculated using the Guideline Value (GLV) of land. Importantly, CMDA considers the GLV in the year the DRC is utilised, not when the land was surrendered.

  • If TDR is used on the same site, additional FSI is directly adjusted—no separate DRC is issued.
  • If TDR is used on a different site, a value-based multiplication factor (V) is applied. The Floor Space Index (FSI) credit here is calculated by comparing the GLV of the export site (the land you surrender) with the GLV of the import site (where the DRC is used), and the ratio between these two values directly affects how much extra FSI is allowed.
    • V = GLV of surrendered land ÷ GLV of receiving land
      • Higher-value surrendered land used in lower-value areas results in more usable FSI.
      • This prevents misuse and keeps TDR economically balanced.

Claiming Higher FSI? Proof Is Mandatory

CMDA will not automatically assume your surrendered land qualifies for higher FSI meant for Multi-Storeyed Buildings (MSB).

To claim for FSI 2.00 or above, the owner has to prove it by submitting detailed, technically valid plans of the existing development on that site, showing that it actually meets MSB norms under the Development Regulations. If it is not a convincing proof , CMDA will simply treat the land as a lower-FSI category, which directly reduces the FSI credit.


Validity, Transfer, and Cancellation of DRC

A Development Rights Certificate is valid for 5 years and can be renewed once for another 5 years upon payment of a revalidation fee. CMDA maintains detailed registers tracking issuance, transfer, and utilisation.

A DRC can be cancelled

  • if obtained fraudulently,
  • if the land title is disputed, or
  • if the property is encumbered in a way that restricts development rights.

What If TDR Cannot Be Implemented?

If land required for public infrastructure cannot be obtained through TDR, CMDA retains the power to invoke land acquisition laws. TDR is a facilitative option—not a legal shield against acquisition.


Why This Matters for Property Owners and Developers

TDR is not “free FSI.” Its value depends on zoning, guideline values, eligibility proof, and timing. Poor planning can turn a DRC into a paper asset with no real takers.
