TNRERA's latest circular puts financial consequences behind misleading and non-compliant real estate advertisements in Tamil Nadu.

Tamil Nadu RERA Moves from Guidelines to Enforcement

The Tamil Nadu Real Estate Regulatory Authority (TNRERA) has taken a significant step towards strengthening transparency in property advertisements by introducing a structured penalty framework for advertisement-related violations. Through its circular dated 24 June 2026, which comes into force on 1 July 2026, the Authority has categorised violations into major and minor breaches and prescribed minimum penalties for each.

The move signals a shift from merely prescribing compliance requirements to actively enforcing them through monetary penalties.

What Does the New Circular Say?

Under the circular, the following have been categorised as

Major Violations

Advertising an unregistered real estate project.

Publishing advertisements without the project’s TNRERA Registration Number and Form-C QR Code.

Displaying unreadable or irrelevant QR codes.

Comparing project prices with alleged “market prices” or prices of competing projects.

Minor Violations

Mentioning only the registration number or only the QR code.

Failure to mention the TNRERA website.

Failure to disclose the promoter’s office address.

Failure to state that a project is a “RERA Exempted Project”, where applicable.

Penalties Prescribed by TNRERA

Violation

Project Cost

Minimum Penalty

Major

₹100 crore and above

₹5,00,000

Major

Less than ₹100 crore

₹2,00,000

Minor

₹100 crore and above

₹1,00,000

Minor

Less than ₹100 crore

₹50,000

TNRERA has also clarified that it may invoke higher penalties available under the Real Estate (Regulation and Development) Act, 2016 wherever the circumstances warrant.

TNRERA_Circular_1483_2026_watermark (2)Download

Background: Advertisement Norms Were Already in Place

Over the past year, TNRERA had already issued several directions requiring promoters to display the project’s TNRERA Registration Number, Form-C QR Code, promoter details and other disclosures in all advertisements, including those published on digital and social media platforms.

TNRERA’s concern over misleading advertisements extends far beyond missing QR codes and registration numbers. Earlier regulatory discussions had highlighted practices such as exaggerated amenities claims, misleading travel-time representations, vague disclaimers, government-like scheme branding, unverifiable luxury claims and pre-launch promotions without necessary approvals.

The regulator’s latest penalty framework reinforces its intent to ensure that every claim made in a property advertisement is accurate, verifiable and does not create a false impression among homebuyers.

As of now, the latest circular strengthens the existing framework by prescribing a clear and structured penalty mechanism for violations.

Why This Circular Matters

The new framework is likely to significantly alter how developers, channel partners, digital marketers and property portals approach project advertisements.

Every advertisement—whether in newspapers, brochures, social media posts, online listings or video campaigns—will now require greater compliance checks before publication.

The circular also reflects TNRERA’s growing emphasis on ensuring that homebuyers receive accurate and verifiable information before making purchasing decisions.

A Wake-Up Call for the Real Estate Industry

For developers and marketing agencies, the message from TNRERA is clear: compliance with advertisement norms is no longer merely a procedural requirement. Non-compliance now carries clearly defined financial consequences.

As the real estate sector increasingly relies on digital marketing and social media promotions, the new penalty framework is expected to usher in greater accountability and reduce misleading property advertisements in Tamil Nadu.

Short-term rental income is attractive, but residential-use compliance decides whether it can survive.

Short-Term Guest Stays Are Not Always Treated Like PG Arrangements

Many property owners assume that listing a flat on Airbnb is the same as allowing a paying guest. But legally and practically, both may not be viewed in the same way.

A paying guest arrangement usually looks more like residential occupation, especially when the stay is longer, stable, and properly documented. Airbnb-style short-term rentals, on the other hand, often involve frequent guest turnover, online bookings, tourist stays, and hotel-like use of a residential flat.

That is where the risk begins.

What the Recent Mumbai Dispute Shows

A recent Mumbai cooperative housing society dispute has brought this issue into focus. The case involved a flat owner who wanted to keep paying guests through agencies and online portals such as Airbnb, while the housing society objected to such use. The Bombay High Court noted that the housing society was not willing to permit the activity and that the dispute was already before the Cooperative Court. The High Court also observed that a writ petition against the cooperative housing society was not maintainable because the society was a private entity.

Reports on the Cooperative Court ruling state that Airbnb-style short-term rentals in residential flats were treated as commercial activity when they resembled lodging or hotel-style use. The court reportedly upheld the society’s objection, especially where approval and compliance were absent.

The important point is this: the issue is not simply whether a flat is rented out. The issue is how the flat is being used.

Why Short-Term-Rentals May Be Seen Differently from PG Use

A PG arrangement usually involves a person staying in the property for a longer period, often for work, study, or residential convenience. The occupant may use the home like a resident.

Short-term-rental stays are different when they involve short bookings, frequent check-ins and check-outs, tourist guests, online platform pricing, cleaning between stays, and hotel-like guest handling. These factors can make the activity look less like residential use and more like a lodging business.

That difference matters because most residential societies are formed for residential living, not for running hospitality operations from individual flats.

Society Rules Can Make or Break the Listing

Housing societies usually rely on bye-laws, general body resolutions, security concerns, and residential-use restrictions when objecting to short-term rentals. If the society has passed a resolution restricting commercial use or requiring prior permission for paying guests, the owner may face a serious obstacle.

In the Mumbai matter, the High Court noted that the petitioner wanted to keep paying guests in his apartment on commercial terms through agencies and portals such as Airbnb, while the society’s members were not agreeable to the same.

This means a property owner should not look only at ownership rights. They must also check society rules, municipal permissions, building-use classification, and local licensing requirements.

BMC’s View on Short-Term Rentals

The Brihanmumbai Municipal Corporation’s short-term rental policy note also shows why authorities are looking more closely at this sector. The note recognises that platforms like Airbnb, Oyo, MakeMyTrip, and StayVista are used for short-term stays in residential premises. It also states that short-term rental use in residential premises is treated as a commercial activity requiring regulation under municipal law.

This does not mean every Airbnb listing is automatically illegal. But it does mean hosts cannot assume that residential ownership alone is enough.

What Hosts Should Be Careful About

If you are planning to operate a short-term rental from a residential flat, avoid treating it like a hotel. Terms like “deluxe suite,” “room service,” “front desk,” “hotel room,” or “premium lodging” can strengthen the impression that the flat is being commercially operated.

Instead, keep the positioning residential and accurate. Use terms such as “private room,” “guest bedroom,” “home stay,” or “family stay” only if they truly reflect the actual use.

More importantly, check whether the housing society allows such activity. A written society NOC, proper leave and licence documentation, police intimation where applicable, municipal compliance, and tax clarity can reduce future disputes.

The Real Estate Risk for Buyers and Investors

This issue is not limited to existing hosts. It also matters for investors buying flats mainly for Airbnb income.

Before purchasing a residential flat for short-term rental income, buyers should check whether:

Society permits short-term rental use

The building has past objections against paying guests

The flat is in a purely residential zone,

Local municipal rules require licensing

The apartment has security and visitor restrictions

The sale deed, bye-laws or association rules restrict commercial activity.

A property that looks profitable on Airbnb may become difficult to operate if the society later objects.

How Verified.RealEstate Can Help

Before buying or using a property for rental income, Verified.RealEstate can help buyers and investors review key property risks through document checks, ownership checks, approval checks, zoning review, road access, neighbourhood suitability, and other due diligence layers.

For Airbnb, PG, serviced apartment, or homestay-style plans, this early verification is important because the risk is not only about title.

It is also about permitted use, society restrictions, local compliance, and future dispute exposure.

Conclusion

Airbnb-style short-term rental is not the same as ordinary residential occupation in every situation. When a flat starts functioning like a hotel, the housing society may have stronger grounds to object, especially if there is no prior permission or compliance.

The safer approach is simple: do not assume that ownership gives unlimited usage rights. Check society rules, municipal requirements, building permissions, and documentation before turning a residential flat into a short-term rental business.

A single case has triggered a nationwide audit of illegal constructions and misuse of residential land.

From a Tamil Nadu Dispute to a National Legal Turning Point

A case that began as a local dispute in Tamil Nadu has now expanded into a nationwide legal intervention. While examining unauthorized construction, the Supreme Court of India identified a much larger issue — widespread misuse of residential properties for commercial purposes across India.

What appeared to be an isolated violation has now exposed a systemic breakdown in urban regulation and enforcement.

“Alarming State of Affairs” — Court Flags Serious Lapses

The case originated from Tamil Nadu (Loganathan vs State of Tamil Nadu) where:

A G+1 building was constructed without proper approval

It exposed serious lapses by local authorities

The Court expressed strong concern over how a one-and-a-half-storey building could be constructed without being noticed by authorities. It described this as an alarming failure of governance, indicating that such activity could not have taken place without the involvement or support of municipal officials.

This observation significantly shifts the narrative — from individual violations to possible institutional accountability and collusion.

Supreme Court’s Strong Observations

The bench noted after observing this case that

Residential colonies are being illegally converted into commercial zones

These violations:

Break zoning laws & building bye-laws

Cause traffic, pollution, and infrastructure stress

Harm genuine homeowners

👉 The Court clearly indicated:

Such large-scale violations cannot happen without official connivance (implied observation across reports)

It stressed that this is not an isolated violation but a nationwide governance failure

Misuse of Residential Areas Under Scrutiny

Going beyond the individual case, the Supreme Court of India highlighted a growing trend where residential areas are increasingly being used for commercial activities.

The Court made it clear that as the usage is illegal and against zoning laws It leads to serious environmental and civic consequences, including congestion and infrastructure strain

This reinforces a key principle — residential zoning is legally binding, not flexible.

Pan-India Inquiry Ordered

Unhappy with the explanations provided by authorities, the Court has taken an unprecedented step:

All States and Union Territories are now involved

Municipal bodies in capital cities have been made parties to the case

Authorities must:

Identify illegal constructions and misuse

Submit detailed affidavits, personally verified by officials before May 15, 2026

This effectively converts the case into a nationwide audit of urban violations.

What Falls Under Illegal Use

The investigation is expected to cover:

Shops operating within residential buildings

Offices and commercial setups in housing layouts

Clinics, PG accommodations, and guest houses

Buildings constructed or modified without approval

Any deviation from approved land use or building norms will now face scrutiny.

Real Estate Impact: A Shift Towards Compliance

This ruling has serious implications for the property market:

For Property Owners

Risk of sealing, penalties, or demolition

Loss of income from unauthorized commercial use

For Buyers

Greater need for due diligence:

Zoning compliance

Approval verification

Illegal-use properties become high-risk investments

For Developers

Increased scrutiny on:

Project approvals

Layout planning

Reduced scope for informal mixed-use practices

Authorities Under Direct Accountability

A key takeaway — administrative authorities themselves are now under the scanner.

Municipal bodies may face:

Legal scrutiny

Internal disciplinary action

Accountability for negligence or collusion

This marks a significant shift toward top-down enforcement of governance standards.

What Happens Next

In the coming weeks:

📊 Surveys will be conducted across cities

📑 Affidavits will be submitted to the Court

🚨 Enforcement actions may include:

Sealing of properties

Demolition of illegal structures

Penalties for violations

This is expected to trigger one of the largest nationwide crackdowns on urban violations in recent years.

🔍 What Is the New Rule About?

From 2026, the Income Tax Department has introduced a major compliance update:

👉 Any property gift valued at ₹45 lakh or more will now be reported to the tax department.

This is done under:

Rule 237 of Income-tax Rules, 2026

Through Statement of Financial Transactions (SFT)

What does this mean?

Property registrars (sub-registrar offices) will automatically report such transactions

The government will know:

Who gifted the property

Who received it

The value of the property

The date of transfer

👉 In short:
Property gifts are now fully traceable.

🔄 What Has Changed Compared to Before?

🕒 Earlier System:

Only property sales above ₹30 lakh were reported

Property gifts were mostly not tracked

🆕 New System (2026):

Property gifts above ₹45 lakh are also reported

Included under the same reporting ecosystem (SFT)

👉 This closes a major loophole where people used the gift route to avoid scrutiny.

💰 Are Property Gifts Taxable?

This is where many people get confused.

✅ When Property Gifts Are NOT Taxable

You don’t pay tax if the gift is received from:

Parents

Spouse

Siblings

Lineal ascendants/descendants (grandparents, children)

On the occasion of marriage

👉 These are called “specified relatives”

❌ When Property Gifts ARE Taxable

You must pay tax if:

The gift is from a non-relative

And the value is more than ₹50,000

💡 Important:

The entire property value becomes taxable

It is taxed under “Income from Other Sources”

📊 Stamp Duty Value Rule (Very Important)

Tax is calculated based on:

👉 Stamp Duty Value (government value)
NOT the value you mention in the document

⚠️ Why this matters:

Even if you show a lower value

Tax department will consider the higher official value

🧠 How the Government Will Track You

This is the most important shift.🔗 Data Tracking System

Authorities will:

Collect data from registrars

Use data analytics tools

Compare:

Your income

Your property transactions

Your financial history

🚨 Example of Red Flag

Your income: ₹5 lakh/year

You receive property worth ₹1 crore

👉 This mismatch can trigger:

Tax notice

Detailed scrutiny

⚠️ High-Risk Scenarios You Must Avoid

1. Not Reporting a Taxable Gift

If you receive property from a non-relative and don’t report it:

👉 Consequences:

Treated as hidden income

Penalty up to 200% of tax

Interest + possible legal action

2. Using “Adjustment” or Fake Gift Structures

Example:

You pay for a property

Register it in someone else’s name

Later they “gift” it back to you

👉 Tax department will check:

Who actually paid the money?

Did the person have financial capacity?

🚨 Result:

Treated as unexplained investment

Can trigger:

Tax reassessment

Benami transaction case

⚖️ Benami Law Risk (Serious Consequence)

If found suspicious:

Property can be treated as benami

Government can:

Attach or confiscate the property

Initiate legal proceedings

👉 This is not just a tax issue—it can become a criminal and civil liability case

📌 No Change in Family Gift Rules

Important clarification:

👉 The government has NOT changed:

Definition of “relative”

Tax exemption for family gifts

✔ So:

Gifting within family is still safe

But now it must be properly documented and explainable

📅 Why the Government Introduced This Rule

The main objective is to:

Stop tax evasion through gift transactions

Detect:

Undisclosed income

Proxy ownership

Benami properties

👉 This is part of a larger shift toward financial transparency

🧾 Practical Checklist: What You Should Do

If you are involved in property gifting:

1. Maintain Proper Documentation

Registered gift deed

Relationship proof

Source of funds

2. Check Tax Applicability

Relative → No tax

Non-relative → Fully taxable

3. Always Disclose in ITR

Even if exempt, safer to report

Avoid mismatch with government data

4. Avoid Artificial Structures

No proxy ownership

No circular transactions

🧠 Final Insight (Most Important)

👉 The law itself is not new
👉 But enforcement is now extremely strong

Earlier:

Gifts could go unnoticed

Now:

Every high-value property gift is:

Recorded

Analyzed

Verified

⚡ One-Line Summary

Property gifts above ₹45 lakh are now fully tracked—if not properly reported and justified, they can lead to heavy tax, penalties, or even legal action.

A simple guide to the future of property registration in Tamil Nadu

The Tamil Nadu Registration Department is upgrading its registration framework through a new digital platform called STAR 3.0. This system will replace the existing STAR 2.0 software used in Sub-Registrar Offices and TNREGINET services.

STAR 3.0 is a full system upgrade, not just a website refresh. It is being built to make property and document registration faster, stricter, more transparent, and digitally controlled across Tamil Nadu.

This article explains what STAR 3.0 is, why it is being introduced, its core features, how it affects property buyers and sellers, and how to stay prepared.

What is STAR 3.0 in Tamil Nadu Registration?

STAR 3.0 is the next-generation core software of the Tamil Nadu Registration Department. It will handle all major registration-related functions, including:

Property document registrations

Sub-Registrar Office workflows

Identity verification

Stamp duty and registration payments

Certified copy services

Digital document storage and retrieval

The system is designed with automation, validation checks, and fraud control at its core.

In simple terms:
👉 STAR 3.0 is the new digital engine running property registration in Tamil Nadu.

Why STAR 3.0 is being introduced (and what it aims to fix)

The existing registration system has long-standing limitations:

Heavy reliance on manual office processes

Delays caused by paperwork and human intervention

Scope for impersonation and document misuse

Weak linkage between land records, buildings, and registrations

Limited real-time verification

STAR 3.0 is being introduced to address these gaps and build a future-ready registration system with the following goals:

Reduce dependency on physical office visits

Speed up registration timelines

Improve document authenticity and traceability

Digitally capture property ground reality

Enable better monitoring and policy-level oversight

Key objectives of STAR 3.0

The new system is being designed around six core goals:

1. Process automation

2. Stronger fraud control

3. Faster registrations

4. Digital-first approach

5. Better data connection

6. Ready for future upgrades

Core features expected under STAR 3.0

1. Smarter, automated registration workflows

STAR 3.0 is expected to introduce system-driven checks for:

Document formats and mandatory clauses

Party identity and role validation

Property detail consistency

Missing or conflicting information

These checks reduce human error and prevent weak or inconsistent documents from passing through unnoticed.

2. Faster processing inside Sub-Registrar Offices

Once a registration token is issued, STAR 3.0 aims to complete execution, indexing, and record creation much faster than before.

This benefits:

Buyers and sellers

Lawyers and document writers

Banks and financial institutions

Senior citizens and out-station parties

3. Expanded digital services

The platform is structured to support more services digitally, such as:

Online applications

Digital payment flows

Electronic document storage

Certified copy downloads

Faster document retrieval

This reduces repeat visits and manual follow-ups.

4. Stronger monitoring and audit systems

STAR 3.0 provides the department with better tools for:

Real-time transaction tracking

Data analytics and reporting

Fraud pattern identification

Office performance monitoring

While these tools serve governance needs, they indirectly improve service quality for citizens.

Ground reality linkage and what buyers must prepare for

One of the most important shifts under STAR 3.0 is the stronger linkage between documents and physical property reality.

The system is moving toward connecting registration records with:

Property photographs

Location coordinates

Clear identification of land and buildings

This makes it harder to push through:

Fake site sales

Duplicate registrations

Undeclared constructions

Misrepresentation of vacant land

What this means for buyers and sellers

✔ Document accuracy becomes critical
Survey numbers, extents, boundaries, patta details, and building descriptions must align cleanly.

✔ Physical property clarity matters
Unapproved floors, hidden units, or mismatched site descriptions carry higher risk.

✔ Clean document chains are essential
Missing links or poorly drafted deeds are more likely to be flagged.

✔ Site-level proof gains importance
Photos and location clarity are no longer optional safeguards.

✔ Verification before registration is crucial
Issues ignored early may surface at the registration stage and cause delays or rejection.

STAR 3.0 vs STAR 2.0 – simple comparison

Area

STAR 2.0

STAR 3.0

Core system

Legacy platform

Modern, scalable system

Automation

Limited

High automation

Fraud control

Mostly manual

Technology-assisted

Property proof

Minimal

Geo-linked data

Processing speed

Moderate

Designed for faster flow

Future upgrades

Limited

Built for expansion

Is STAR 3.0 live?

STAR 3.0 is a phased modernisation program. Different features may roll out gradually across offices and services.

Some changes may appear within workflows before public announcements.

Users should watch for:

Updated registration steps

New document or data requirements

Changes in token or appointment systems

Additional digital verification stages

Final thoughts (clear and direct)

STAR 3.0 tightens registration, even as it simplifies the process

Manual flexibility is reducing; system validation is increasing

Document accuracy and ground reality now carry higher weight

Proper verification before registration is no longer optional

👉 Under STAR 3.0, clean documents and real properties will pass smoothly. Weak or unclear ones will not.

Verified.RealEstate Helps You Register Safely Under STAR 3.0

With stricter digital checks under STAR 3.0, even small errors in property records can delay or block registration. Verified.RealEstate helps buyers and owners verify survey details, patta, document continuity, and on-ground property alignment before registration, reducing last-minute issues and compliance risks in the new digital registration system.

Digitised, transparent, and faster—Tamil Nadu’s land-use change approval system enters a new era.

Tamil Nadu Launches a Fully Digital Land-Use Change System

The Tamil Nadu Government has officially enabled complete online processing for Change of Land Use (CLU) applications under both CMDA and DTCP limits. Through the OnlinePPA single-window portal, citizens, architects, and developers can now submit applications, upload documents, track status, and receive approvals without visiting government offices.

This digital transformation improves transparency, reduces human intervention, and significantly accelerates approval timelines.

These properties have strict regulations governing their use, transfer, leasing, and management. Buying or leasing Waqf land involves specific guidelines that differ substantially from regular property transactions. This guide provides a detailed overview of Waqf properties in Tamil Nadu, including essential rules, verification processes, lease procedures, and useful online tools to ensure compliance and transparency in 2025.

Ongoing Compliance: Follow all terms and conditions specified, including regular payments and property usage restrictions.

4. Importance of Verification & Due Diligence

5. Challenges & Considerations with Waqf Land
