Tamil Nadu Fixes an ‘Anywhere Registration’ Hurdle: Free Online EC Now Accepted

Tamil Nadu has made its Anywhere Registration process a little easier. People registering eligible property documents online were earlier told to obtain an Encumbrance Certificate (EC) by paying a fee. Now, the free EC available online is sufficient for certain documents, including first-sale deeds for homes and plots in new projects and specified mortgage documents.

What was the practical difficulty?

Anywhere Registration allows eligible documents to be registered without visiting a Sub-Registrar’s office. But applicants were told to obtain a paid EC even though an EC could be accessed online for free. People raised concerns about this extra requirement, and the Registration Department has now changed the procedure.

What else has changed?

According to the report:

  • Mortgage documents involving the deposit of title deeds can also be submitted through the Citizens’ Gateway.
  • An EC need not be checked when registering a receipt document issued after a property loan is fully repaid.
  • No extra holiday fee is required for registration through the no-visit process.
  • A special authority document called “presentation power” cannot be used for this online process, as the document can be presented online from anywhere.

What should property buyers remember?

This change makes a registration requirement simpler. It does not make the property purchase or registration free. Buyers should still check the property’s ownership history, loans, approvals and other risks before paying for it. An EC is one part of that check; it is not a guarantee that the property has no problems.
