Simplifying High-Rise Project Clearances in Tamil Nadu

The Chennai Metropolitan Development Authority (CMDA) has approved around 17 high-rise building proposals within barely a month of receiving greater approval powers. The number is equal to the total high-rise approvals issued by the authority during the whole of 2024, indicating a significant acceleration in the planning process.

Ministerial Approval Requirement Removed

Previously, proposals for high-rise buildings exceeding 18.3 metres in height had to pass through two main levels:

The proposal was examined by a committee chaired by the CMDA Member Secretary.

Even after committee clearance, the file had to be forwarded to the Tamil Nadu government for final approval by the minister, who served as CMDA chairman.

Under the new system, CMDA can directly approve the proposals, so the files no longer need ministerial clearance. This is expected to reduce such delays.

This change was introduced through a Housing and Urban Development Department government order G.O. (Ms) No.126 dated June 15, 2026. The amendment followed CMDA’s request for greater authority under the Tamil Nadu Combined Development and Building Rules, 2019.

This revised system removes the need for a separate ministerial-level approval after CMDA scrutiny.

Approval Numbers Show a Sharp Rise

CMDA approved 66 high-rise proposals in 2021, followed by 58 in 2022 and 30 in 2023. The number dropped to 17 in 2024 and just nine in 2025.

However, following the recent rule change, nearly 17 proposals were cleared within about a month. Several applications had reportedly remained pending for years under the earlier approval system.

CMDA Member Secretary Rahul Nadh said removing the government-level approval stage could save around two months in the processing of high-rise applications.

Developers Expect Faster Project Clearances

The real estate industry has welcomed the reform, as it removes one administrative layer and may help developers begin projects sooner. Faster planning approvals could also reduce financing costs and prevent prolonged project delays.

However, the change does not exempt developers from obtaining other mandatory permissions.

Developers must still obtain all applicable statutory permissions, which may include:

Environmental clearance

Airport Authority or aviation-related clearance

Fire and rescue services clearance

Traffic and infrastructure-related approvals

Other permissions depending on the project’s height, size, location and use

Verified Real Estate assists developers in coordinating and obtaining these statutory approvals, helping them in ensuring a smoother and hassle-free project approval process.

What the Reform Means for Chennai Real Estate

The rapid clearance of 17 high-rise proposals suggests that the new system could improve the ease of doing business in Chennai’s construction sector. It may also encourage developers to take up larger residential, commercial and mixed-use projects across the metropolitan region.

The long-term impact will depend on whether CMDA can maintain faster approval timelines while ensuring that projects continue to comply with planning, safety, infrastructure and environmental regulations.

Youth-led “March for the Marshlands” intensifies debate over Chennai’s Mamallan Reservoir project and its impact on coastal wetlands.

Nearly 30 youth organisations joined the “March for the Marshlands” in Chennai on July 25, opposing the Mamallan Reservoir project and demanding protection for the coastal wetland identified for its construction. The protesters urged the Tamil Nadu government to halt the project and conduct an independent scientific assessment before allowing further work.

The Mamallan Reservoir Project

The Mamallan Reservoir was proposed by the Tamil Nadu Water Resources Department and formally launched by the previous DMK government led by M.K. Stalin in January 2026.

Planned in the Kovalam sub-basin near Nemmeli in Chengalpattu district, the reservoir would extend across parts of Tiruporur and Thirukazhukundram taluks, between East Coast Road and Old Mahabalipuram Road.

Estimated project cost: approximately ₹342.60 crore

Project area: roughly 5,100 acres

Proposed daily supply: up to 170 MLD, or 17 crore litres

It was planned to serve nearly 13 lakh residents across Chennai’s rapidly expanding southern suburbs, spanning from Sholinganallur to Thiruporur. It also aims to capture surplus monsoon runoff, strengthen water security, and reduce seawater intrusion.

The reservoir was initially assessed at around ₹471 crore in the project’s environmental report, but the cost announced when construction was launched was ₹342.60 crore.

To now more about it : Read https://community.verified.realestate/article/a-%e2%82%b9471-crore-coastal-reservoir-near-kovalam-is-set-to-transform-chennais-southern-water-security/

The Tamil Nadu Water Resources Department divided the work into phases/packages and invited contractors through competitive tendering for this project.

For Phase 1, Package 1, covering the reservoir’s eastern and southern sides:

Tender value was approximately ₹164.61 crore.

The tender was published in November 2025.

P&C Projects Pvt. Ltd. was subsequently awarded a contract reported at about ₹166.9 crore.

The contractor was reportedly given 24 months to complete this package.

However, as the project has moved from proposal to execution, it has also drawn growing scrutiny from environmental groups, local residents and youth organisations. While the government presents the reservoir as a critical infrastructure project to address Chennai’s long-term drinking water needs, concerns have emerged over the ecological nature of the proposed site.

What is officially described as a development zone is, according to critics, part of a sensitive coastal landscape that plays a key role in the region’s natural drainage and biodiversity systems.

Protesters Say the Site Is a Living Wetland

The protesters argue that the project site is not vacant or unused land, but a functioning tidal marsh and coastal wetland ecosystem.

They fear that converting the brackish marsh into a freshwater reservoir would disturb the natural mixing of freshwater and seawater, affecting fish, prawns, crabs, birds and other species dependent on the wetland.

A fisherman from Kovalam said wetlands protect coastal communities and cities and should not be destroyed in the name of climate resilience.

Fishing Livelihoods Could Be Affected

The marshlands serve as fishing and breeding grounds for communities living around Kovalam and adjoining coastal villages.

Protesters warned that changes in water flow and salinity could reduce fish and prawn populations and threaten the livelihoods of fishing families. They also argued that Irulars, Dalits and other marginalised communities could bear the environmental and economic costs while the reservoir’s benefits are supplied to urban areas elsewhere.

Concerns Over Buckingham Canal and Flooding

One of the major allegations is that reservoir bunds and structures may obstruct the Buckingham Canal and natural coastal drainage routes.

Opponents fear that blocking or restricting these channels could increase waterlogging and flood risks during intense monsoon rainfall. They also warn that permanently converting a tidal marsh into an artificial freshwater storage area could cause irreversible ecological damage.

Protesters Demand an Independent Study

The youth organisations are not simply opposing additional drinking-water supply for Chennai. They want the government to prove that the project will not damage the wetland, increase flooding or destroy local livelihoods.

They have demanded an independent study covering:

tidal and floodwater movement;

impact on Buckingham Canal;

fish-breeding and fishing areas;

changes in salinity and groundwater;

effects on birds and wetland biodiversity; and

alternative locations or water-supply solutions.

The Mamallan Reservoir has now become an important environmental test for the present Tamil Nadu government. The central question is whether Chennai’s need for drinking water can be addressed without destroying a natural wetland that already provides flood protection, biodiversity and livelihoods to coastal communities.

From Tiruvottiyur to Coimbatore — ITC’s blueprint for a water-secure India is turning sustainability into action! 💧🌱

🌊 Rejuvenating Chennai’s Water Heritage

In a landmark step toward urban sustainability, ITC Limited, in collaboration with the Greater Chennai Corporation (GCC) and IIT Madras, has rejuvenated six water bodies in Tiruvottiyur, North Chennai. This initiative — highlighted in The Hindu and CSR reports — increased the storage capacity by over three million cubic feet, directly benefiting surrounding communities through improved water availability and groundwater recharge.

The project exemplifies ITC’s holistic Urban Water Management Initiative, which operates across Chennai, Coimbatore, and Bengaluru, where the company’s units are located. By addressing urban challenges such as flash floods, falling groundwater levels, and recurring water shortages, ITC is helping shape resilient, climate-conscious cities.

💧 Integrated Urban Water Management: A Model for the Future

Recognising the escalating water stress in urban India, ITC has implemented a series of structured, community-led programmes that focus on:

💦 Reviving urban water bodies to restore ecological balance and enhance storage capacity.
💦 Improving drainage systems to reduce flood vulnerability during monsoons.
💦 Implementing rooftop rainwater harvesting across industrial and residential units.
💦 Recharging groundwater and shallow aquifers, ensuring long-term sustainability.
💦 Developing models for water treatment and recycling to support agricultural use and reduce fresh-water dependency.

These interventions not only restore nature’s balance but also ensure that communities benefit from cleaner, more reliable water resources year-round.

🤝 Partnerships that Empower and Transform

ITC’s water initiatives thrive on collaboration across levels of society and governance:

💧 Community Partnerships: Local user groups are empowered to plan, co-invest, and maintain rejuvenated water systems.
💧 Implementation Partnerships: Civil-society organisations ensure on-ground execution and community engagement.
💧 Public–Private Partnerships (PPPs): Partnerships with NITI Aayog, NABARD, IWMP, and MGNREGS help scale effective water models and influence sustainable policy frameworks.
💧 Knowledge Partnerships: Institutions like IIT Madras, IISc Bengaluru, WWF India, and IUCN contribute research, hydrological expertise, and innovation to combat water risks.

🌍 Visible Impact in Tiruvottiyur and Beyond

The Tiruvottiyur rejuvenation project has had a tangible, measurable impact:

💦 Groundwater levels have improved from 2.8 m to 2 m, replenishing household wells.

🌱 A scientific hydrological study mapped degradation factors like siltation, sewage inflow, and solid waste accumulation, enabling targeted restoration.

🚮 Nearly 68 tonnes of waste were removed, and sewer lines were redirected to treatment plants, restoring the natural ecosystem.

Beyond Chennai, similar projects in Coimbatore and Pudukkottai are creating scalable models for sustainable water management across Tamil Nadu.

🌿 ITC’s Bold Sustainability 2.0 Vision for 2030–2035

Under its Sustainability 2.0 Agenda, ITC has announced ambitious water conservation and efficiency goals:

🌧️ Rainwater harvesting potential to exceed five times the company’s net water consumption by 2030.

💧 40% reduction in specific water consumption in operations (based on FY 2018-19 baseline).

🌾 2,000 million kilolitres of water to be saved through improved crop water-use efficiency and demand-side management in agri-value chains.

✅ Alliance for Water Stewardship (AWS) certification for all ITC sites in high water-stressed areas by 2035.

🌍 30% overall reduction in water consumption across ITC businesses by 2030.

Courts have spoken: open space is not for sale

Open Space Reservation (OSR) is a mandatory planning requirement under the Tamil Nadu Town and Country Planning Act, 1971 and allied Development Control Rules.
Every approved layout must earmark 10 % of its total extent as land reserved for community use — parks, playgrounds, or green zones. The developer executes a registered gift deed transferring that portion to the local body or planning authority, ensuring it remains public property.
The intent is simple: protect urban breathing space amid relentless construction. Courts have repeatedly treated misuse or diversion of OSR land as an encroachment on the collective right to clean air, recreation, and ecological balance.

Below are four recent judicial milestones (2022 – 2025) that defined the enforcement of OSR norms in Tamil Nadu.

⚖️ 1. Association of Vasanth Apartments Owners v. CMDA & Ors.

Supreme Court of India | 13 Feb 2023 | C.A. Nos. 1890-91 of 2010 & 7847-48 of 2013

Background

Residents of a 12-block complex (> 10,000 m²) had already gifted their OSR land to CMDA in 1994. When the land was later used as a connecting road, the association claimed ownership and demanded that it be retained as a private park.

Core Issue

Can flat owners reclaim or control OSR land once it’s gifted to CMDA?
Is Rule 19 of the Development Control Rules (10 % OSR + gift deed) constitutional?

Court’s Reasoning

Once gifted, title vests *irrevocably in the local authority; residents have no proprietary right.

CMDA may use the land for any legitimate public purpose, including a road, provided the objective remains public welfare.

Rule 19 is a valid regulatory restriction, not *expropriation.

Order / Holding

Appeals dismissed; CMDA’s and Corporation’s actions upheld.

OSR reservation and gift-deed mandate affirmed as *constitutional.

Excerpt:

“Reservation of ten percent area for communal and recreational purposes is not a taking but a reasonable regulatory measure… execution of a registered gift deed ensures the land is not exploited later for private purposes.”

⚖️ 2. Trellis South Flat Owners Welfare Association v. CMDA & Ors.

Madras High Court | Justice M. Dhandapani | W.P. No. 17008 of 2022 | 14 Oct 2022

Background

The petition related to the alienation of OSR land by the CMDA authorities in favour of the respondents, viz., Chennai Metro Rail Ltd. (CMRL), the land that was maintained by the Trellis South flat Owners Welfare Association, who is the petitioner . CMDA alienated this OSR land to CMRL for infrastructure works.
Similar use of OSR land at Shenoy Nagar Park had earlier prompted a Supreme Court undertaking that the park would be restored — an undertaking the agencies had failed to honour.

Core Issue

CMDA promised to restore the park and greenery after using OSR land for Metro construction, but didn’t do it — so the High Court stepped in again to enforce accountability and monitor restoration through a committee.

Court’s Reasoning

The State must honour its word; development cannot come at the cost of nature.

The Court is the “custodian of law,” duty-bound to enforce environmental undertakings.

Status reports filed by CMRL were “*bereft of detail” and failed to show genuine restoration.

Order / Directions

Constituted a five-member Restoration Committee (Amicus Curiae + CMDA + CMRL + Horticulture Dept + Local Residents) to monitor regreening.

Ordered periodic reports and field inspections.

“Development should be directly proportional to maintenance of the environment… any destruction to the environment under the guise of development spells doomsday for the nation.”

🌳 3. S.P. Thiyagarajan v. Commissioner, Tirunelveli City Municipal Corporation

Madras High Court | 12 Apr 2022

Background

The petitioner sought permission to convert land reserved as a park/playground into residential plots.

Core Issue

Whether land earmarked as OSR in an approved layout can later be converted for private use.

Court’s Reasoning

OSR dedication creates a permanent public trust.

Neither the promoter nor subsequent owners can alter or sell it.

Allowing conversion would “defeat the very scheme of the layout.”

Order / Holding

Conversion refused.

Directed the Corporation to preserve the area as a park and take action against any encroachment.

“The land earmarked as park and playground must remain so for public benefit and cannot be alienated by any individual.”

🚇 4. CMRL Skywalk / Sewer Works on OSR Land (Vadapalani)

Madras High Court | Aug 2025 | Reported Times of India

Background

Residents objected to Metro authorities using OSR land (already gifted to CMDA) for constructing a skywalk and underground sewer line near Vadapalani.

Core Issue

To create a seamless, fare-controlled connection between Vadapalani Metro Phase I and Phase II stations, which will allow passengers to transfer between lines without exiting the fare zone. To lay a new sewage pipeline as the existing one for the Phase I station was damaged by roadworks. To determine Whether this temporary use of OSR land for civic infrastructure violates its protected status.

Court’s Reasoning

Public infrastructure of unavoidable necessity can coexist with OSR preservation if usage is temporary and reversible.

CMDA remains custodian; land cannot be commercially exploited or permanently re-purposed.

Ordered strict timeline and post-completion restoration.

Order / Holding

Allowed construction subject to restoration of the open area.

Directed transparency and community updates.

Excerpt:

“Public convenience, when temporary and reversible, can coexist with preservation of OSR land… such projects shall not change its character or title.”

🏞️ The Importance of OSR and the Legal Stand on Encroachments

Open Space Reservation (OSR) land is not just another vacant plot — it is a legally protected public asset meant to serve as the green lungs of urban neighbourhoods. These spaces preserve ecological balance, improve air quality, and provide recreation and mental relief in crowded cities.

Once a layout is approved with designated OSR areas, that land becomes untouchable for private or commercial use. Any construction, sale, or alteration of OSR land amounts to encroachment on community property and is treated as an illegal act under the Tamil Nadu Town and Country Planning Act.

Courts in Tamil Nadu have consistently ruled that no individual, association, or authority has the right to alter the purpose of OSR land, and violators can face demolition, restoration orders, and even contempt proceedings.

Calculate mandatory 10% open space reservation requirements for layouts and developments in Tamil Nadu. Determine whether to reserve land or pay fee-in-lieu based on plot size, jurisdiction, and development type as per 2024 regulations.

Build your dream home faster—harness Tamil Nadu’s Self-Certification Scheme for hassle-free, cost-effective plan approvals.

In Tamil Nadu, constructing a small residential building (up to 2,500 sq.ft. plot area and a built-up area of up to 3,500 sq.ft.) has become notably easier with the introduction of the Self-Certification Scheme (SCS). Announced during the 2024–2025 Budget session and officially launched on July 22, 2024 by Chief Minister M.K. Stalin, this scheme allows ground or ground + one residential constructions—up to 7 meters in height—to be self-certified via a single-window online portal. Here’s everything you need to know to leverage this simplified permit process.

1. What Is the Self-Certification Scheme?

Objective

To streamline building plan approvals for small-scale homes up to two dwelling units (Ground or Ground + One Floor) without exceeding a 7-meter height.

Key Benefits

Faster Approvals: Applicants can secure a permit by self-declaring compliance with existing rules.

Reduced Charges: Traditional scrutiny fees and certain infra/amenities charges are waived, replaced by a simplified Consolidated Fee.

Instant Downloads: After e-signing declarations and making a flat-rate payment, applicants can download their permit and building plan instantly (unless an NOC is required based on the GIS location).

2. Who Is Eligible Under SCS?

Plot Ownership

You must be the owner, leaseholder, or power of attorney holder of the land, with legal rights to develop it.

Plot & Built-Up Limits

Plot size: Up to 2,500 sq.ft.

Built-up area: Up to 3,500 sq.ft.

Building height: Maximum 7 meters, limited to ground or ground + one floor.

Approved Plots Only

Valid for plots in approved layouts, layouts regularized under the 2017 Unapproved Layouts rules, or plots registered before October 20, 2016.

3. Non-Applicability of the Scheme

This scheme does not apply to areas or plots under:

CRZ (Coastal Regulation Zone)

HACA (Hill Area Conservation Authority)

Lands designated for agricultural, institutional, special/hazardous, or other restricted zones

Areas falling under road widening or public purpose reservations in Master Plans, Detailed Development Plans, etc.

4. Consolidated Fees & Charges

Flat-Rate Fee

All planning-related charges (Development Charge, Building Licence Fee, TN Construction Workers Welfare Fund, Road Cut Restoration, etc.) are combined into a single per sq.ft. rate.

For Chennai, it’s ₹100/sq.ft. built-up area. Elsewhere, rates differ based on municipalities and town panchayats(Refer the PDF attached below for exact rates).

No Scrutiny or Amenities Charges

The usual scrutiny fees and certain other charges are waived under SCS.

Transparent Payment

All fees are paid online during the application, ensuring immediate clarity on total costs.

5. Step-by-Step Online Application

Register on Single Window Portal

Go to onlineppa.tn.gov.in and register with your Aadhaar.

In Tamil Nadu, purchasing a property involves ensuring the documents are authentic, clear of encumbrances, and legally valid. One crucial step is to obtain a certified copy of the property deed and compare it with the original document. This process helps you detect any potential forgery or tampering before you finalize the transaction. Below is a complete guide on how to apply for a certified copy and perform a basic authenticity check.

2. Why Compare Certified Copy with the Original Document

3. Steps to Obtain a Certified Copy in Tamil Nadu
