<p class="wp-block-paragraph">A recent Madras High Court case from Thiruneermalai, Tambaram taluk, involved a dispute between <strong>N. Balakrishnan</strong> and <strong>S. Anandhan</strong> over the ownership and development of a parcel of land.</p>



<p class="wp-block-paragraph">The case is important because it explains one clear point: <strong>TNRERA registration does not finally decide who owns disputed land.</strong></p>



<h2 class="wp-block-heading">The Case Details</h2>



<p class="wp-block-paragraph">Balakrishnan claimed that the property belonged to him. He said that his father had purchased the land and that he later inherited it.</p>



<p class="wp-block-paragraph">Anandhan claimed rights over the same property and wanted to develop it as a housing project.</p>



<p class="wp-block-paragraph">Anandhan had already filed a civil case against Balakrishnan, seeking an injunction to prevent him from interfering with the property. The civil court granted an interim injunction in Anandhan’s favour while the ownership dispute remained pending.</p>



<p class="wp-block-paragraph">While this dispute was continuing, Anandhan obtained approval and registered a housing project with the Tamil Nadu Real Estate Regulatory Authority, or TNRERA.</p>



<p class="wp-block-paragraph">Balakrishnan objected to the registration. He argued that:</p>

<li>He was the actual owner of the land.</li>



<li>A civil case and injunction were already pending.</li>



<li>The dispute should have been disclosed to TNRERA.</li>



<li>TNRERA should not have registered the project without considering his objection.</li>

<p class="wp-block-paragraph">Balakrishnan approached the Madras High Court after TNRERA refused to cancel the registration.</p>



<h2 class="wp-block-heading">Why did the High Court refuse to cancel the registration?</h2>



<p class="wp-block-paragraph">The Court examined the difference between the powers of TNRERA and a civil court.</p>



<p class="wp-block-paragraph">Under Section 4(2)(l) of the RERA Act, a promoter must declare that the promoter has legal title to the land and that the land is free from encumbrances. TNRERA can examine these declarations.</p>



<p class="wp-block-paragraph">If it is clear from the documents that the promoter has no title or that the land has a serious encumbrance, TNRERA can refuse registration.</p>



<p class="wp-block-paragraph">However, the Court said that TNRERA cannot conduct a full trial to decide which person is the true owner when both sides produce competing claims.</p>

<p class="wp-block-paragraph">The High Court allowed Balakrishnan to continue pursuing his claim before the civil court.</p>
