<p class="wp-block-paragraph">The landlord obtained an eviction decree against Kishori. Another son of the original tenant, Ashok, later argued that he had also inherited the tenancy and could not be evicted because he was not included in the case.</p>



<p class="wp-block-paragraph">When the original tenant died, eligible family members succeeded to the tenancy. But the Supreme Court said they did not receive several independent tenancies.</p>



<p class="wp-block-paragraph">They inherited <strong>one single tenancy together</strong>:</p>

<li>One rent;</li>



<li>One landlord–tenant relationship; and</li>

That supported the conclusion that Kishori was acting on behalf of the persons claiming under the common tenancy. <strong>The Court therefore held that the eviction decree against her bound the other family members as well.</strong> It also relied on the factual finding that <strong>Ashok had stopped residing there years earlier.</strong></p>



<p class="wp-block-paragraph">The Supreme Court expressly said that whether one tenant represents the others depends on the circumstances. It did <strong>not</strong> create an absolute rule that an eviction case against any random family member will always bind everyone.&nbsp;</p>



<p class="wp-block-paragraph">The Court held that the eviction decree was binding on them and dismissed their appeal.&nbsp;</p>



<h2 class="wp-block-heading">What Does Tamil Nadu Law Say?</h2>



<p class="wp-block-paragraph">Under Section 6 of the Tamil Nadu tenancy law of 2017, the tenancy may pass to the tenant’s spouse, sons or unmarried daughters, parents, or widowed daughter-in-law for the <strong>remaining period of the rental agreement</strong>.</p>
