You cannot take land and refuse to pay—Supreme Court sends a strong message.

Government Used Private Land for 25 Years Without Acquisition

In a significant ruling protecting property rights, the Supreme Court has dismissed an appeal filed by the State of Chhattisgarh after it occupied private land for nearly 25 years without acquiring it or paying compensation to the landowners.

Calling the State’s challenge “absolutely baseless”, the apex court not only upheld the enhanced compensation and interest awarded to the landowners but also imposed costs of ₹2 lakh on the State.

The judgment reiterates that the government cannot deprive a person of their property without following due process of law and paying fair compensation.

How Did the Dispute Begin?

The dispute dates back to 1986, when the Chhattisgarh Public Works Department (PWD) took possession of privately owned land in Durg district and used it for a road project.

However, the State neither initiated land acquisition proceedings nor paid any compensation to the landowners.

For years, the landowners remained unaware of the illegal occupation.

Encroachment Discovered During Demarcation Proceedings

The encroachment came to light during 1demarcation proceedings.

After discovering that the PWD had occupied their land, the owners filed a suit in 2006, seeking eviction of the department from their property.

State Initiated Acquisition After 24 Years

Only after the litigation commenced did the State begin the acquisition process.

On 13 August 2010, nearly 24 years after taking possession of the land, the government issued a notification under Section 4 of the Land Acquisition Act, 1894, formally initiating acquisition proceedings.

Compensation Fixed by Land Acquisition Officer

In June 2011, the Land Acquisition Officer passed the final award and determined the compensation at:

₹4,308 per square metre

The valuation was based on the 2009-10 guideline value.

Landowners Challenged Compensation

The landowners argued that the compensation was inadequate because the 2010-11 guideline values had already come into effect before the final award was passed.

The Reference Court accepted their contention and enhanced the compensation to:

₹5,380 per square metre

by applying the updated 2010-11 guideline rates.

High Court Upholds Enhanced Compensation and Awards Interest

Both the State and the landowners approached the Chhattisgarh High Court.

The High Court upheld the enhanced compensation and further directed the State to pay interest from the date the landowners first approached the court in 2006.

The Court ordered:

9% interest for the first year, and

15% interest per annum thereafter until the entire compensation amount is paid.

The High Court recognised that the landowners had been deprived of both their land and compensation for several decades.

State Challenges Interest Before Supreme Court

Unhappy with the interest awarded, the State approached the Supreme Court.

The government argued against the High Court’s direction to pay interest on the compensation amount.

However, the Supreme Court refused to interfere.

Supreme Court’s Verdict

A Bench comprising Justice Sandeep Mehta and Justice Vijay Bishnoi strongly criticised the State’s conduct.

The Court observed that:

The State had occupied private land for decades without authority of law.

The landowners were forced to approach the courts because of the government’s inaction.

The State could not take advantage of its own wrongdoing.

The award of interest by the High Court was fully justified.

The Supreme Court noted that after illegally occupying private property for decades, the State should have complied with the compensation order instead of continuing litigation.

What Was the State Ordered to Pay?

✅ Pay compensation at the enhanced rate of ₹5,380 per square metre instead of ₹4,308 per square metre.

✅ Pay 9% interest for the first year, calculated from 2006, the year the landowners first approached the court.

✅ Pay 15% interest per annum thereafter until the entire compensation amount is fully paid.

✅ Pay an additional ₹2 lakh as costs for filing what the Supreme Court termed an “absolutely frivolous” appeal.

Article 300A: Right to Property Still Protected

The judgment is an important reminder that although the Right to Property is no longer a fundamental right, it remains a constitutional right under Article 300A of the Constitution of India, which states:

No person shall be deprived of his property save by authority of law.

The ruling makes it clear that governments cannot occupy private property first and think about compensation later.

Why This Judgment Matters for Property Owners

The judgment sends a strong message to government authorities across the country:

✔ Illegal occupation of private land cannot be justified on the ground of public purpose.

✔ Delays in initiating acquisition proceedings do not extinguish the rights of landowners.

✔ Courts can award enhanced compensation and substantial interest where owners have been deprived of their property for years.

✔ Governments can also be penalised with costs for pursuing frivolous litigation.

The Bottom Line

The Supreme Court’s decision reinforces a simple but powerful principle:

If the government uses your land, it must acquire it legally and pay fair compensation. Decades of delay cannot deprive landowners of their constitutional rights.

Property Owners Must Stay Vigilant

This case also highlights the importance of property owners regularly monitoring their land records and physical property boundaries. Conducting survey and demarcation checks can help identify encroachments, boundary disputes, or unauthorised changes at an early stage.

For owners who hold multiple properties or live abroad, keeping track of every asset can be challenging. Tools such as Verified Real Estate’s Property tracker can provide instant alerts whenever there is a change in land records, helping owners stay informed and take timely action.

Similarly, Verified Real Estate’s Property Management services can assist owners with multiple properties and NRIs by monitoring, managing, and safeguarding their real estate assets even when they are not physically present.

Demarcation is the process of identifying and physically marking the exact boundaries of a property based on land records and survey documents. ↩︎

In co-living, smart operations—not just property—create real profits.

Co-Living Is No Longer Just About Property

In 2026, co-living in India has changed a lot. Earlier, people thought it was just about renting a building and giving rooms to tenants. Now, that approach doesn’t work.

Today, tenants expect more than just a place to stay. They want:

Fully furnished rooms

Easy, hassle-free living

Quick support when something goes wrong

Locations close to work or college

Because of this, co-living operators must act like hotel managers, not landlords. The focus has shifted to service quality and reliability, which now decide whether rooms stay occupied.

Understanding Co-Living Business Essentials

Category

Key Points

Business Models

Lease Model: High risk (fixed rent, variable income)
Management Model: Revenue sharing, lower risk, popular
Hybrid/Franchise: Mix of both, depends on location

Key Cost Drivers

Rent/lease (largest cost), staff salaries, housekeeping, maintenance, marketing, technology costs
👉 Small drop in occupancy = major profit impact

Occupancy

Ideal: 85–95%
Below this → margins shrink
👉 Fast tenant replacement + good reviews are critical

Churn (Tenant Turnover)

Tenants: students & early professionals
Short stays, frequent switching
👉 Higher onboarding costs + increased marketing spend

Location Matters—But It’s Not Everything

Properties near IT parks, colleges, and metro areas are in high demand. These locations:

Attract more tenants

Allow better pricing

But there’s a catch:

Property costs are very high

Rules and approvals can be complicated

Running costs increase due to frequent tenant changes

So, even in a good location, profits are not guaranteed. Operators must manage everything efficiently to make money.

Best Locations in Chennai for Co-Living Demand and Occupancy

Chennai offers several strong micro-markets for co-living investments, especially where young professionals and students cluster.

Areas along the Old Mahabalipuram Road (OMR)—including Perungudi, Thoraipakkam, and Sholinganallur—are among the top choices due to their proximity to IT parks and steady demand from tech employees.

Similarly, the Guindy–Velachery belt benefits from connectivity to both commercial hubs and educational institutions, ensuring consistent occupancy.

For student-driven demand, locations near Anna University and IIT Madras perform well. Emerging zones like Porur and Ambattur are also gaining traction due to lower entry costs and growing employment hubs. The key is to pick areas with strong job density, good public transport access, and a constant inflow of migrants, as these factors directly support high occupancy and stable returns in co-living setups.

Operations Decide Profit

Many people think investing money in co-living is enough to earn good returns. That’s not true.

Running a co-living space involves:

Frequent tenant movement

Daily cleaning and upkeep

Regular repairs

Constant effort to fill empty rooms

All of this costs money. If occupancy drops, profits drop quickly.

This is why:

Passive owners struggle

Skilled operators succeed

The real winners are those who can control costs and maintain high occupancy.

Scaling Is Harder Than It Looks

The demand for co-living is strong because more people are moving to cities. But growing the business is not easy.

The challenge is:

Not buying more buildings

But managing multiple properties properly

Maintaining the same service quality everywhere is difficult. Investors now look for operators who can handle this scale effectively.

To manage multiple properties better, services like Verified.RealEstate’s Property Management can help track maintenance, tenants, and overall operations in a more organized way.

Technology Makes a Big Difference

Technology is becoming essential in co-living. Operators use:

Apps for booking and rent payments

Systems to handle complaints and repairs

Smart access and security features

What Investors Are Realizing Now

The co-living market is still growing because:

Cities are expanding

Young professionals need flexible housing

But investors have become smarter. Instead of only asking:
👉 “Where should I invest?”

They now ask:
👉 “Who is managing this property?”

Because returns depend on:

Good management

Stable occupancy

Strong cost control

Competition Is Increasing

The co-living market is:

Highly competitive

Very price-sensitive

Operators cannot just increase rent to earn more. They must:

Improve services

Keep costs under control

This balance is what separates successful businesses from failing ones.

Final Takeaway

Co-living may look simple, but it’s not.

Success depends on:

Keeping rooms occupied

Managing costs properly

Delivering good service consistently

In today’s market:
👉 Property alone doesn’t create value—management does.

Operators who treat co-living like a serious, service-driven business will succeed in the long run

Elevate your work environment—choose coworking for flexibility, modern amenities, and endless networking opportunities.

In today’s rapidly evolving business landscape, many startups, freelancers, and even established companies are opting for coworking office spaces instead of traditional leased offices. These shared work environments promise flexibility, cost savings, and vibrant networking opportunities. But is a coworking space the right fit for your business? This guide explores the advantages, potential drawbacks, and key considerations to help you decide whether to transition to a coworking office space.

1. What Is a Coworking Office Space?

Definition:
A coworking office space is a shared working environment where professionals from diverse industries work side by side. These spaces offer a blend of convenience, flexibility, and community.

Key Features:

Flexible Leases: Short-term rental options without long-term commitments.

Shared Amenities: Access to meeting rooms, high-speed internet, printing services, and common areas.

Community & Networking: Opportunities to connect with professionals from various sectors, fostering collaboration and knowledge exchange.

2. Advantages of Coworking Spaces

Flexibility:
Coworking spaces offer short-term leases and the ability to scale up or down based on your evolving business needs.

Cost Efficiency:
Sharing amenities such as internet, reception, and meeting rooms lowers your overall overhead costs compared to renting a traditional office.

Networking Opportunities:
Being in a shared environment exposes you to diverse professionals, potentially leading to partnerships, client referrals, or collaborative projects.

Modern Infrastructure:
These spaces are typically designed with contemporary aesthetics and state-of-the-art facilities, which can enhance productivity and workplace satisfaction.

Community Engagement:
Regular events, workshops, and networking sessions can foster professional growth and keep you informed about industry trends.

3. Potential Drawbacks of Coworking Spaces

Distractions and Noise:
With multiple businesses sharing the same space, noise levels and frequent interruptions can sometimes affect concentration.

Limited Privacy:
Open layouts and shared facilities might not be ideal for sensitive projects or confidential discussions.

Brand Identity:
A shared space might not offer the dedicated branding and corporate identity that a private office can provide.

Space Constraints:
Depending on your team size or the nature of your work, the available space in a coworking setup might feel restrictive.

4. Key Considerations Before Making the Switch

Business Needs:
Assess whether your work demands high levels of privacy or if a collaborative environment could boost creativity.

Team Size and Growth:
Evaluate if your current team size and future growth plans align with the flexible nature of coworking spaces.

Budget:
Analyze the cost benefits—consider not just rent savings, but also additional services and networking opportunities that might justify any extra expense.

Location:
Consider proximity to major transportation hubs and how the location could benefit your business or attract clients.

Trial Period:
Some coworking spaces offer trial memberships. Taking advantage of a trial can help you assess whether the environment suits your needs without a long-term commitment.

5. Services & Tools to Enhance Your Workspace Experience

Everything You Need to Know About Power of Attorney: Legal Implications and Risks.

Introduction
A Power of Attorney (POA) is a legal document that allows an individual, known as the principal, to grant authority to another person, the agent or attorney-in-fact, to perform tasks or make decisions on their behalf. Whether for managing property, handling legal matters, or conducting financial transactions, a POA is a powerful tool. This guide will walk you through the key points to understand about the POA, its types, usage, and associated legal obligations.

1. What is Power of Attorney (POA)?

A Power of Attorney is a legally binding document through which the principal authorizes an agent to act on their behalf in specific tasks or a broad range of activities.

2. Purpose of a POA

A POA helps individuals delegate authority to an agent due to various reasons such as workload, lack of time, or inability to be physically present. Multiple agents can be appointed through a POA, and this flexibility makes it essential in personal and business matters.

3. Types of Power of Attorney

There are two primary types of POAs:

Special Power of Attorney (SPA) – Grants authority for specific tasks.

General Power of Attorney (GPA) – Allows an agent to handle a broad range of activities.

4. Special Power of Attorney (SPA)

An SPA is used for specific tasks, such as representing someone in court, purchasing property for someone abroad, or handling one legal matter. It’s limited in scope, meaning the agent is authorized to carry out only the particular task outlined in the POA.

5. General Power of Attorney (GPA)

A GPA provides the agent with broader authority to handle multiple tasks such as managing property, securing loans, and entering financial agreements. It offers more flexibility compared to an SPA.

6. Examples of SPA Usage

Common tasks for an SPA include filing lawsuits, buying property, or handling legal matters for someone who is unavailable or unable to act in person.

7. Court-Related SPA

An SPA issued for a court case may involve several steps, but it is still considered a single task under the law. The agent’s authority is valid only for that particular case.

8. GPA and Multi-Tasking

A GPA can be used to manage a wide range of tasks such as property management, loan processing, mortgaging property, and even leasing or renting properties.

9. Appointment of Multiple Agents

While it’s possible to appoint multiple agents through a GPA, it is essential to specify whether the agents need to act jointly or if they can act independently. If this is not specified, all agents must act together.

10. Revoking Power of Attorney

A POA can be revoked at any time by drafting a revocation deed and registering it with the sub-registrar’s office. This ensures that the agent no longer has authority to act on the principal’s behalf.

11. Binding Authority of POA

Until officially revoked, any actions taken by the agent under the POA are legally binding on the principal. These actions will be regarded as if the principal performed them personally.

12. POA Termination

A POA automatically becomes invalid if the principal dies, becomes mentally incapacitated, or if the POA is revoked.

13. Special POA for Non-Property Matters

In non-property matters, an SPA can be notarized through a public notary without registration. However, for property-related matters, it must be registered.

14. General POA for Property

A GPA that involves property transactions, especially the sale of property, must be registered at the sub-registrar’s office. If the GPA transfers ownership, it is mandatory to register it.

15. Time Limit for GPA Validity

A GPA is valid for 30 days from the date of execution. After this, the agent must obtain a life certificate from a government doctor to prove that the principal is still alive for further actions.

16. Caution When Buying Property from a POA Holder

Extra caution must be taken when purchasing property from an individual who holds a POA. It’s important to verify the life certificate and validity of the POA before completing any transaction.

17. Stamp Duty for POA

The stamp duty required for POAs varies:

Special POA: ₹20 stamp paper.

General POA: ₹100 stamp paper.

POA involving money exchange: 4% stamp duty on the transacted amount.

18. Registration Fees for POA

Registration fees depend on the nature of the POA:

Non-property related POA: ₹150.

Property-related POA: ₹10,000.

POA involving money exchange: 1% of the transacted amount.

19. Risk of Fraud

One significant risk associated with POAs is the potential for fraud if the agent is not trustworthy. It is important for the principal to be cautious when appointing an agent.

20. Indemnity Bond

It’s recommended that the principal obtain an indemnity bond from the agent, ensuring that any illegal actions taken by the agent will be their responsibility, not the principal’s.

Proactively manage your property and avoid common pitfalls caused by negligence and human factors.

Introduction

Managing property effectively involves more than just keeping track of legal documents or paying taxes. It requires a comprehensive approach that includes regular inspections, a deep understanding of legal documentation, and an awareness of human factors such as negligence and family dynamics. Whether you are a seasoned property owner or someone dealing with inherited land, these essential insights will help you navigate common pitfalls in property management and handle challenges posed by human errors and negligence.

1. Routine Property Checks

One of the most common mistakes property owners make is failing to physically inspect their properties regularly. Whether you’ve purchased the land, inherited it, or acquired it through other means, it’s vital to dedicate time to visit the property. Check the boundaries, inspect the conditions, and ensure that markers or trees that delineate the land are intact and correct. Neglecting this simple task can lead to disputes over land boundaries or encroachment by neighbors.

2. Document Review

Property documents, including deeds, titles, and land records, are often overlooked. It’s crucial to carefully read these documents, understand the measurements, and cross-check the legal descriptions with what exists on the ground. If there are discrepancies, it’s best to consult with the local administrative offices to resolve them early. By regularly reviewing these documents, you can avoid future complications, especially when selling or transferring the property.

3. Understanding Documentation

Many older property owners, especially those with limited experience in legal matters, may struggle to comprehend legal documents. This lack of understanding can lead to confusion and mistakes that may complicate property management. It’s essential to develop basic reading skills for legal documents or seek help from a legal advisor to ensure everything is in order.

4. Involvement of Senior Family Members

Often, younger family members leave property management to older generations, assuming it’s their responsibility. However, involving senior family members in the property’s legal and financial affairs ensures better management. Younger members can help with online platforms and resources, while senior members offer historical context and experience, creating a balanced and efficient approach.

5. Follow-Up on Legal Issues

It’s common for property owners to submit complaints or legal challenges without following up persistently. Many assume that once a complaint is submitted, the issue will resolve itself. Unfortunately, that’s rarely the case. Continuous follow-up is necessary to ensure that problems are addressed in a timely manner.

6. Collaborative Problem-Solving

Younger family members familiar with online resources and legal procedures should work closely with senior family members to resolve property issues. This collaborative approach streamlines problem-solving, ensures that no important tasks are neglected, and brings modern solutions to traditional property challenges.

7. Online Resources for Property Management

In regions like Tamil Nadu and Puducherry, property owners have access to various online platforms for checking land records and managing legal documents. Being familiar with these platforms can make property management much easier. These tools provide transparency and allow property owners to stay informed about the legal status of their assets.

8. Utilizing Government Online Services

Many government services, including those from district collectors and even the Chief Minister, are now available online. Complaints and queries can be submitted through digital channels, making it easier for property owners to resolve issues without physically visiting government offices. Younger family members with online expertise can assist older generations in navigating these services.

9. Educating Older Generations

Knowledge-sharing between generations is key to successful property management. Older family members should educate younger ones about property documents, land terminology, and legal processes. This mutual learning ensures that both generations are well-prepared to handle property-related issues.

10. Handling Property Sales and Disputes

Disputes over land boundaries or government land classifications can cause significant delays and financial strain during property sales. Addressing these problems involves negotiations and dealing with bureaucracy. It’s important to be proactive, gather the necessary documents, and handle disputes with a clear legal strategy.

11. Urgency and Fees

Like booking urgent railway tickets, property document corrections often come with additional fees when handled on short notice. Budgeting for these extra costs is essential to avoid delays or unexpected financial burdens.

12. Avoiding Pitfalls with Revenue Departments

Dealing with revenue departments can be frustrating, with bureaucratic delays and high processing fees. Property owners should be prepared for potential challenges and budget for unexpected costs when working with these departments. Patience and persistence are key to successfully navigating these bureaucratic processes.

13. Cost-Benefit Analysis of Property Management

Managing property issues can be costly, but proper planning and efficient management often prove more cost-effective than dealing with the consequences of neglect. Investing time and resources in proactive property management can save you from major financial losses down the road.

Safeguard Your Investment: Regular Property Oversight is Essential!

Many people believe that simply owning property is enough—whether through purchase or inheritance. They assume that as long as they have the title deed and don’t engage in any further transactions, their property will remain secure. However, this is a serious misconception. Failing to actively manage and monitor your property can lead to unforeseen legal issues, which can drain both time and money. This guide explores real-world examples and explains why regular property oversight is essential.

Property Ownership Isn’t a One-Time Task

It’s common for people to buy land or inherit ancestral property and leave it unattended, assuming it’s secure as long as the paperwork is in order. However, property ownership isn’t passive. There are hidden risks that, if not addressed, can cause major problems. This article highlights why regular vigilance is necessary for protecting your property.

A Case of Carelessness: The Example of a Landowner Near Chennai

A landowner bought an acre of land near Chennai, secured the title deed, fenced the property, and periodically visited to check on it. From his perspective, everything was secure. However, when the government recently digitized property records, the title deed was transferred to someone else’s name during the update process. The new titleholder even used this fraudulent title to secure an agricultural loan. The landowner was unaware of this until it was discovered by chance, causing him great distress. Now, he is making frequent trips to the revenue office to correct this mistake. This situation could have been avoided by regularly checking online records.

Mistakes in Documentation: A Story from Tiruppur

In Tiruppur, a landowner purchased property, updated the title to his name, and installed fencing. His survey number was 17. However, when another individual filed a legal mortgage case for a different property with the survey number 71, a clerical error occurred, mistakenly registering the case under survey number 17. This mistake went unnoticed for two years until the actual owner, on a friend’s suggestion, checked the Encumbrance Certificate (EC). He was shocked to find that a mortgage case had been filed against his land. Now, he is also making trips to the Sub-Registrar’s office to correct this error. A simple annual check of the EC could have prevented this issue.

The Importance of Regular EC Checks

It’s crucial to check your EC at least once every six months to ensure that no unauthorized transactions or errors have been recorded. This can help you catch any mistakes or fraudulent activities early on, saving you from future legal battles.

The Perils of Trusting Others: A Case from Coimbatore

A property owner in Coimbatore had an ancestral home with all the necessary documents—title deed, tax payments, and electricity bills—in his name. He entrusted the property to a relative, who lived next door, to manage in his absence. The owner only visited the property once a year. Over time, the relative created unregistered lease agreements for the property, forging the owner’s signature, and rented the house out for years. Eventually, the relative filed a court case under the tenancy law, claiming the right to purchase the property. The actual owner is now embroiled in a lengthy legal battle. This situation could have been avoided if the owner had managed the property himself and not left everything in the hands of others.

Neglecting Property Can Lead to Fraud

In another case from a village near Salem, a property owner rented out his village house to a tenant who paid rent every six months. For over ten years, the owner never visited the property but collected the rent diligently. Meanwhile, the tenant found it difficult to sell a nearby piece of land due to access issues. So, he decided to fraudulently sell the rented house, using the adjacent land as part of the deal, even though he didn’t own it. The buyer moved into the house, unaware of the fraud. The original owner remained oblivious, as the tenant continued paying rent. Only after an investigation did the owner realize what had happened. Now, a legal dispute is underway to reclaim the property from the buyer.

Frequent Property Visits and Regular Oversight Are Essential

It’s critical to not only check documents such as title deeds and ECs regularly but also to visit your property often. Don’t rely on others to pay taxes or utility bills on your behalf. Handling these responsibilities yourself ensures you stay informed about the status of your property and can prevent fraudulent activities.

Static vs. Dynamic Properties

Many people purchase vacant land, expecting its value to appreciate over time. While this may be true, land left unattended and unmanaged can invite trouble. Instead, it’s better to treat properties as dynamic assets, generating income through rental agreements, agricultural activities, or commercial endeavors. Actively using your property not only increases its value but also ensures that it remains in your control and is less susceptible to fraudulent claims.

Conclusion

Owning property is not just about possessing documents and occasionally checking on it. Property, like any other asset, requires active management. Regularly checking records, ensuring proper maintenance, and staying informed about the status of your property can save you from expensive legal battles and sleepless nights. Don’t let your property sit idle—manage it well, and it will reward you in the long run.
