A Shocking Lease Scam in Chennai

A 43-year-old property owner from the Gerugambakkam–Moulivakkam belt was recently arrested after cheating more than 15 families by collecting lakhs as lease advance for the same house. Several victims came forward only after they realised the house was already “leased” to someone else — and the owner had disappeared with their money.

This type of fraud is becoming disturbingly common in fast-growing neighbourhoods such as Porur, Moulivakkam, Gerugambakkam, Mangadu, and Kolapakkam, where demand for rentals is high and documentation checks are often skipped.

How the Fraudster Operated

The accused was the actual registered owner of the property.
Because of this, victims trusted him immediately — he showed real ownership documents, real tax receipts, and even allowed house visits.

Here’s how he cheated people:

1. Showed Genuine Ownership to Gain Trust

Since he was the registered owner, his documents matched:

Patta

EC

Property tax

Aadhaar + deed details

Victims felt safe and didn’t expect fraud from a genuine owner.

2. Collected Lease Advances from Many Families

He offered a very attractive lease amount and said:

“Current tenant is moving out soon”

“I’m giving it to whoever pays advance first”

“Confirm today or I’ll give it to someone else”

Each victim paid ₹5–10 lakh, thinking they were the only tenant.

3. Promised Keys on a Fake Future Date

He told every family:

“You can move in from next month.”

This made them quiet for weeks — buying him time to cheat more people.

4. Disappeared After Collecting Crores

When multiple families came on the “handover day,” they found:

The house was still occupied

The owner had switched off his phone

He had moved to a different locality

The scam surfaced only when the victims spoke to each other.

🔍 Key Insight

This case shows a painful truth:

Being the real owner doesn’t guarantee honesty.
Even real owners can run lease scams.

Which is why tenants must check owner behaviour, track record, and multiple-document consistency, not just ownership.

How Chennai Tenants Can Protect Themselves

If you are taking a house on lease in Chennai, do these checks before paying even ₹1:

1. Verify Ownership (Critical)

Use the Verify My Land tool:
https://verified.realestate/tools/verify-my-land
Check:

EC chain

Patta status

FMB

Ownership pattern

Legal alerts

2. Confirm Identity of the Lessor

Ask for:

Aadhaar

PAN

Sale Deed copy

EC

Latest property tax receipts

Cross-check names in all documents.

3. Check for Multiple Lease/Fake Listings

If the same property appears on many ads with different names, that’s a red flag.

4. Register the Lease

Always insist on:

Proper lease agreement

Police tenant verification

Registration at SRO (if amount > ₹50,000)

No serious owner will oppose this.

Legal Action Tenants Can Take

If you suspect fraud:

File a police complaint under IPC 406, 420

Approach the Economic Offences Wing

Gather all receipts, screenshots & chats

Get a legal opinion from property advocates

For legal guidance, visit:
https://verified.realestate/services/legal-opinion

IPC 406 (Criminal Breach of Trust)
IPC 420 (Cheating)

Conclusion

The Porur–Moulivakkam lease scam is a wake-up call for Chennai residents.
Never trust a “good deal” blindly.
Never give a lease advance without verifying ownership.
And always run due-diligence through reliable tools before committing financially.

A few minutes of verification can save lakhs of rupees — and months of stress

Court presses pause on the Sahara–Adani mega-deal until ministries and SEBI weigh in.

Background: The Long Sahara Refund Saga

Sahara India has approached the Supreme Court seeking approval to sell 88 major properties, including the iconic Aamby Valley City near Lonavala (≈8,810 acres), to Adani Properties Pvt. Ltd.
The ₹ 24,000 crore sale proposal, filed on 6 September 2025, aims to clear long-pending investor refunds through the SEBI–Sahara Refund Account.

The case is tangled in overlapping legal restrictions — the Enforcement Directorate’s 707-acre attachment, municipal sealing of Sahara Shaher in Lucknow, and Supreme Court-imposed refund conditions. The apex court may need to invoke Article 142 to lift these barriers and allow a clean transfer of title.

If cleared, this would mark one of India’s largest judicially supervised real-estate transactions, potentially reviving stalled luxury projects like Aamby Valley and setting a precedent for investor-driven asset recoveries. The hearing of this case was scheduled on October 15, 2025.

Read the full in-depth report here https://community.verified.realestate/article/adani-sahara-deal-aamby-valley-sale-faces-legal-hurdles-as-lucknow-civic-body-seals-sahara-assets/

⚖️ Hearing Summary (Held on October 15 2025)

Bench: Chief Justice B. R. Gavai, Justices Surya Kant and M. M. Sundresh

Case: Sahara India Commercial Corporation Ltd vs. SEBI & Ors

Issue: Sahara sought Supreme Court approval to sell 88 properties, including Aamby Valley, Hotel Sahara Star, and Sahara Shaher, to Adani Properties Private Ltd, to raise money for repaying investors.

🧾 What the Court Actually Ordered

Centre and SEBI were asked to respond to Sahara’s proposal.

The Court directed Sahara to formally implead the Ministry of Finance and Ministry of Corporate Affairs as parties to the case.

This means the government will now have to review and state its position on the proposed Adani deal.

Solicitor General Tushar Mehta (for the Centre) said the government must examine the proposal because many cooperative societies had invested in Sahara entities, and those interests must be protected.

*Amicus Curiae Shekhar Naphade was instructed to:

Prepare a detailed chart identifying which assets are disputed, clear, or unclear in ownership.

Coordinate with SEBI, the Union Government, and Sahara to review workers’ claims and investor dues.

Next Hearing: The Supreme Court scheduled the matter for November 17 2025.

On that date, the Court is expected to decide whether to grant approval for the Adani takeover.

* Amicus Curiae is not a party to the case, but someone the court appoints or allows to assist by offering expert insight, legal perspective, or impartial analysis on complicated issues.
The person is usually a senior advocate, legal scholar, or independent expert with no direct stake in the outcome.

💼 Adani Group’s Stand

Senior Advocate Mukul Rohatgi, appearing for Adani Properties, stated the company is willing to buy all 88 properties together, even if some are under dispute, to avoid fragmented litigation.

The group submitted a term sheet dated 6 September 2025, confirming its commitment.

💰 Use of Sale Proceeds

Sahara said all proceeds from the sale would be deposited into the SEBI–Sahara Refund Account — the same account used to repay investors of Sahara’s optionally fully convertible debentures (OFCDs).

🕰️ Context — Why This Sale Matters

In 2012, the Supreme Court ordered Sahara to refund over ₹24,000 crore raised through OFCDs, with 15% interest.

Sahara claims to have paid around ₹16,000 crore so far; SEBI says ₹9,000 crore still remains unpaid.

The Court has allowed Sahara in the past to sell or jointly develop assets to generate funds — e.g., the Versova land case in 2024 (which fell through after environmental issues were found).

🔍 Bottom Line

No sale approval yet. The Supreme Court hasn’t cleared the Adani takeover.

Centre + SEBI responses pending. They must file their views before November 17.

Aamby Valley remains under Sahara ownership until further orders.

The October 15 hearing was procedural — setting up government involvement and fact-finding before any green light is given.

A landmark real-estate sale caught between billion-dollar ambitions and courtroom realities.

A High-Value Deal Under Supreme Court Lens

Sahara India has moved the Supreme Court seeking permission to sell 88 properties — including the iconic Aamby Valley City near Lonavala (≈8,810 acres) — to Adani Properties Pvt. Ltd..
The proposal, filed on September 6, 2025, outlines a bulk asset transfer aimed at settling investor refunds under the SEBI–Sahara Refund Account. The Court is expected to hear the plea on October 14, 2025.

Sahara argues that piecemeal asset sales have failed and that a single-buyer transaction can expedite repayments to lakhs of depositors still awaiting their dues since the 2012 Supreme Court orders.

Legal Complexities Shadowing the Sale

While the move could unlock thousands of crores, the deal is tangled in multiple legal restrictions.

The Enforcement Directorate (ED) attached 707 acres in and around Aamby Valley (worth ₹1,460 crore) in April 2025, citing alleged benami transactions under the PMLA Act.

These attachments remain in force, and unless the Supreme Court issues a blanket clearance under Article 142, the land transfer cannot be executed.

Additionally, some of the assets included in the proposed sale, such as Sahara Shaher in Lucknow, are currently sealed by local authorities — adding yet another layer of dispute.

⚖️ What “Article 142” means in this context

Article 142 of the Indian Constitution gives the Supreme Court the power to pass any order necessary to do complete justice in a case.
It’s an extraordinary power — it lets the Court override ordinary laws or administrative blocks if required to settle the matter fully and fairly.

🔍 How it applies to the Sahara–Adani sale

Right now, Aamby Valley and other Sahara assets are under multiple legal locks —

Enforcement Directorate attachments (under money-laundering laws),

Municipal seals (like Lucknow’s LMC action),

Earlier Supreme Court restrictions tied to investor refunds.

If the Supreme Court wants the Adani sale to go through despite those blocks, it can use Article 142 to:

Suspend or lift those attachments temporarily,

Authorize the sale and transfer of title, and

Direct that the sale proceeds go straight into SEBI’s refund account.

The deal cannot legally proceed unless the Court uses its special constitutional power to override all existing bans, seals, and attachments so the property can be sold cleanly.

Lucknow Municipal Corporation Seals Sahara Shaher

In late September 2025, the Lucknow Municipal Corporation (LMC) sealed nearly 170 acres of Sahara-owned land in Gomtinagar, including parts of the Sahara Shaher campus.
According to LMC officials, the licence deed for ~130 acres (residential and commercial) was cancelled, and the lease for ~40 acres of green-belt land was revoked for alleged violations of lease and usage terms.

The LMC also issued a three-day eviction notice to Sahara, later granting a short reprieve to vacate voluntarily. It has announced plans to file a caveat in the Supreme Court, asserting its right to be heard before any judicial order allows the sale of these disputed assets.

The Aamby Valley Factor

Aamby Valley, the crown jewel of the Sahara portfolio, spans over 8,800 acres and was once envisioned as India’s first fully planned luxury township.
The Supreme Court had earlier ordered its auction in 2017–2018, but the attempt failed due to lack of bidders and unclear land titles.
Now, with Adani’s interest, the project is back in focus — but regulatory clearance, especially concerning ED attachments and court-monitored refund obligations, will determine if this revival is even possible.

Refunds, Approvals, and the Road Ahead

Sahara claims to have deposited ₹16,000 crore with SEBI against the ₹24,030 crore directed by the Court.
In September 2025, the Supreme Court approved ₹5,000 crore disbursal to genuine investors and extended the repayment timeline till 2026.
The upcoming October 14 hearing will decide whether the Adani deal can move forward and whether the Court will lift or modify restrictions tied to the attached assets.

Why It Matters to the Real Estate Sector

If cleared, this could become one of the largest judicially supervised real-estate transfers in Indian history, merging luxury township land, urban assets, and hospitality properties into a single sale.
However, the success of the deal depends entirely on judicial approval, regulatory clean-up, and municipal consent — particularly from ED, LMC, and SEBI.

For buyers, investors, or legal observers, the Aamby Valley case is a stark reminder:
Real estate due diligence must go beyond documents — it must include active court and municipal record verification.

From dream homes to debt traps: India’s Supreme Court takes aim at the real estate mafia.

The long nightmare of Delhi-NCR homebuyers who paid EMIs for apartments that never materialized has finally caught the attention of India’s highest court. In a landmark move, the Supreme Court has authorized the CBI to file 22 FIRs against builders, banks, and regulatory bodies involved in what it called an “unholy nexus.”

At the core of this fraud lies the subvention scheme—a loan model where banks disbursed funds directly to developers, who were supposed to service the EMIs until project completion. Instead, builders defaulted, projects stalled, and unsuspecting families were left paying EMIs for flats that never existed.

Scale of the Scam

The probe reveals the sheer scale of financial malpractice:

Supertech, a well-known real estate giant, allegedly drew loans worth ₹5,157.86 crore since 1998.

Several major NCR developers and multiple lending institutions are now under the scanner.

Local authorities such as Noida Authority, GNIDA, and YEIDA are also being investigated for oversight failures in land allotments and approvals.

The CBI has already raided 47 locations across NCR to gather evidence on project files, loan disbursements, and builder–bank agreements.

Supreme Court’s Stern Words

The apex court did not mince words, calling the scandal a “systemic betrayal” of middle-class aspirations. Regulators like the RBI and National Housing Bank (NHB) were directed to tighten norms and ensure that buyers are not harassed for builder defaults.

A bench of Justices Surya Kant and N. Kotiswar Singh directed that the six preliminary inquiries conducted by the CBI be converted into 22 regular criminal cases (FIRs) for further investigation into the alleged nexus between builders and financial institutions in the Delhi-NCR real estate fraud.

“We accept the recommendation and the CBI shall accordingly register regular cases and proceed in accordance with law.”

The SC also indicated that a Special Investigation Team (SIT)-style monitoring will oversee the CBI’s progress to ensure accountability at every stage.

The bench granted the CBI six weeks to investigate a separate preliminary enquiry concerning projects outside NCR, including cities like Mumbai, Bengaluru, Kolkata, Mohali, and Allahabad.

Impact on Homebuyers

Families who invested their life savings are now hopeful that criminal accountability will translate into project completion or compensation.

The FIRs strengthen homebuyers’ legal position, complementing remedies available under RERA and consumer courts.

What Happens Next

CBI Charge Sheets: The agency will examine builder executives, lending officials, and authority records to establish culpability.

Project Completion Roadmap: Courts may direct escrow monitoring, third-party takeovers, or forensic audits for stalled projects.

Policy Reform: Future loan disbursements may be tightened with stricter tripartite agreements and escrow-linked construction milestones.

Conclusion: A Caution for Chennai

The Delhi-NCR scam is a reminder that even in cities like Chennai, where CMDA and RERA provide oversight, risks of delayed projects and disputed titles still exist. Homebuyers should not depend solely on builder assurances or bank tie-ups. Simple checks—like title verification, approvals, and encumbrance records—can prevent costly mistakes. Tools such as Verified.RealEstate’s Due Diligence and Legal Opinion make this process easier, ensuring that every investment in Chennai real estate is secure and stress-free.

A new era for Karnataka homeowners—stronger rights, smarter rules, and transparent living.

Karnataka is on the verge of a historic legislative upgrade, with the state set to replace its nearly 50-year-old apartment ownership law with a modern, RERA-compliant act. The proposed law, backed by Deputy Chief Minister D.K. Shivakumar, is designed to protect homebuyers, strengthen resident welfare associations (RWAs), and bring clarity to apartment ownership, governance, and maintenance standards in vertical housing communities.

🔑 Why the Change Was Long Overdue

The existing Karnataka Apartment Ownership Act, dating back to the 1970s, no longer meets the needs of a fast-growing, urbanized state where high-rise living is now the norm—especially in Bengaluru. Buyers often found themselves at the mercy of ambiguous laws, poorly managed associations, and limited legal recourse.

The new legislation aligns with the Real Estate (Regulation and Development) Act, 2016 (RERA), making it legally robust and uniform across projects. For property buyers, this means greater transparency, accountability, and protection.

🏢 Major Reforms Under the New Law

RERA-Based Governance: Associations and builder obligations will now fall under the RERA umbrella, offering standardized protection.

Mandatory Formation of Resident Welfare Associations (RWAs).: Builders must facilitate the formation and registration of RWAs once 60% of units are sold.

Financial Transparency: RWAs will be required to maintain audited accounts and disclose usage of maintenance and sinking funds.

Defined Builder Exit Protocol: Builders must transfer control of the project—including documents and common areas—upon completion, reducing delays and disputes.

Digital Documentation: All apartment-related records must be accessible digitally for increased clarity and reduced fraud.

🌆 A Boon for Bengaluru’s Vertical Living Spaces

In Bengaluru—home to thousands of apartment complexes—residents have long struggled with erratic builder handovers, unregistered associations, and opaque maintenance charges. The new law is expected to:

Minimize legal disputes

Empower apartment owners to self-govern

Encourage developers to be more accountable

It could also help reduce project delays and improve the post-occupancy experience for homebuyers—a major pain point in India’s urban housing scene.

📈 Impact on Real Estate Stakeholders

For Buyers: More confidence, fewer hidden costs, legal empowerment.
For Developers: A push toward compliance and structured handovers.
For RWAs: Legal recognition, defined roles, and financial legitimacy.

💬 What the Deputy CM Said

Deputy CM D.K. Shivakumar called this reform a “people-first legal reset,” highlighting that the bill was developed with extensive stakeholder consultation—including builders, RWAs, and civil society groups.

The proposed legislation is currently awaiting final approval and will likely be implemented with amended model bylaws across the state.

When property deals fail, not every dispute is a crime — the Supreme Court draws a hard line.

🏠 The Disputed Deal: Roti Godown in Kanpur

In June 2020, Rikhab Birani and Sadhna Birani entered into an oral agreement to sell Roti Godown No. 28/27 on Birhana Road, Kanpur, Uttar Pradesh, to Shilpi Gupta for ₹1.35 crore. Shilpi Gupta and her husband claim they paid ₹19 lakh between June and September 2020 as part of the sale consideration.

However, according to the sellers, Shilpi was required to pay 25% of the sale amount by 15.09.2020, but failed to do so. A ₹10 lakh cheque she issued bounced due to insufficient funds. Attempts were made via WhatsApp and other communications to remind her to complete the sale, but there was no resolution.

💸 Sale to Another Buyer at a Loss

A year later, on 03.09.2021, the Biranis sold the property to a different buyer for ₹90 lakh, claiming a loss of ₹45 lakh due to the failed earlier transaction. They argued they should not be liable to refund any amount to Shilpi Gupta.

⚖️ Legal Proceedings Take a Criminal Turn

Despite not initiating any civil suit, Shilpi Gupta filed criminal proceedings:

April 2022: Magistrate dismissed her *Section 156(3) CrPC plea—held the dispute was civil.

July 2023: A second criminal complaint was also dismissed for the same reason.

July 2023: She directly filed FIR No. 78/2023 alleging offences under *Sections 420, 406, 354, 504, and 506 IPC.

September 2023: Police filed a chargesheet.

January 2024: Magistrate took *cognizance and summoned the Biranis.

May 2024: High Court dismissed the Biranis’ *Section 482 CrPC petition.

🧑‍⚖️ Supreme Court Verdict: A Case of Civil Wrong, Not Crime

The Supreme Court quashed the FIR and chargesheet, holding that the case was purely civil in nature, lacking essential ingredients of cheating or criminal breach of trust.

The Court emphasized that no fraudulent or dishonest intention was shown at the time of the agreement—a key requirement for criminal charges under Sections 420 or 406 IPC. It strongly criticized the police and trial court for allowing a criminal case to proceed in what was clearly a contractual dispute.

💰 ₹50,000 Cost Imposed on Uttar Pradesh Government

The Court imposed a ₹50,000 penalty on the State of Uttar Pradesh for misusing criminal proceedings in a civil matter. The Chief Secretary has been directed to ensure payment within six weeks and may recover the amount from errant officers.

The Court refrained from penalizing Shilpi Gupta, acknowledging she may have been misled by poor legal advice.

🧭 Why This Matters for Property Buyers and Sellers

This case is a critical reminder that breach of contract alone doesn’t constitute a criminal offence. If you’re involved in a property transaction that fails, your legal remedy lies in the civil courts, not the police station.

Cognizance - judicial acknowledgment or formal awareness of an offence by a court.

CrPC - Code of Criminal Procedure

Section 156(3) CrPC – Allows a Magistrate to direct the police to register an FIR and investigate, if the complaint discloses a cognizable offence.

Section 420 IPC – Punishes cheating and dishonestly inducing someone to deliver property, requiring fraudulent intent at the outset.

Section 406 IPC – Deals with criminal breach of trust, where entrusted property is dishonestly misused or not returned.

Section 354 IPC – Punishes assault or criminal force on a woman with intent to outrage her modesty.

Section 504 IPC – Punishes intentional insult that provokes a person to break public peace.

Section 506 IPC – Punishes criminal intimidation, meaning threats intended to cause fear or force someone to act against their will.

Section 482 CrPC – Grants inherent powers to the High Court to quash criminal proceedings if they amount to an abuse of the legal process or don't disclose any offence.

Chennai’s ₹20,000 Cr Parandur Airport project moves forward with generous land rates — but protests continue.

High Compensation Fixed for Chennai’s Second Airport Project

In a significant move to accelerate the Parandur Greenfield Airport project — Chennai’s proposed second international airport — the Tamil Nadu government has issued a Government Order fixing generous compensation for landowners. The flat compensation rates, set between ₹35 lakh and ₹60 lakh per acre, far exceed the current guideline values (₹5–17 lakh per acre) in many areas.

For high-value locations, payouts could reach up to ₹2.57 crore per acre through private negotiations. This decision aims to smoothen the acquisition of 3,331.25 acres across Kancheepuram and Sriperumbudur taluks — regions central to this ₹20,000-crore infrastructure push.

Affected Areas and Land Value Brackets

The G.O., issued on June 25 by the Industries Department, initiates the formal land acquisition process under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. Affected villages include:

Parandur, Valathur, Ciruvallur, Gunakarapakkam, Akkamapuram, Magadevi Mangalam, Eganapuram, Podavur, Nelvoy, Thandalam, Thodur, and others.

Breakdown of affected lands:

1,960.63 acres: Flat rate ₹35–60 lakh/acre (GLV: ₹5–17 lakh)

374.53 acres: Negotiable if demands exceed flat rate

996.09 acres: GLV above ₹17 lakh — compensation via private negotiation, possibly exceeding ₹2 crore/acre

Legal Pathway for Non-Consent

For landowners unwilling to accept the flat or negotiated rates, the government will acquire lands by following the statutory procedure. This includes:

Valuation of structures and trees

100% solatium (additional compensation)

25% incentive on final valuation

This dual-track approach ensures land acquisition progresses smoothly while offering landowners fair market-aligned returns.

Villagers Continue to Protest Compensation

Despite the government’s offer, resistance remains. The Parandur Airport Protest Committee argues that land values have soared to ₹2–3 crore per acre due to project announcements, making the government’s offer appear insufficient.

Committee leader G. Subramanian told the press: “We are not ready to accept the current offer. It is far below the actual value of our lands.”

A Balancing Act Between Infrastructure and Community

The Parandur airport, once completed, is expected to decongest Chennai International Airport and enhance regional connectivity. But to move forward, the state must balance rapid infrastructure development with equitable treatment of affected communities.

Coastal luxury meets legal reality: CRZ violations in Muttukadu highlight the risks of ignoring environmental norms.

A major crackdown on Coastal Regulation Zone (CRZ) violations is underway in Muttukadu along Chennai’s East Coast Road (ECR), with 22 beachfront residential buildings now under threat of demolition. The Chengalpattu district administration has flagged these constructions as illegal, citing their location within the No Development Zone (NDZ) of CRZ-III, which strictly prohibits permanent structures within 200 metres of the High Tide Line.

Under-Construction Projects Continue Despite CRZ Restrictions

Shockingly, at least six of these structures were still under construction during a recent inspection by government officials. This reveals a blatant disregard for CRZ norms, even after repeated awareness drives and monitoring alerts in coastal zones. The remaining structures include luxurious multi-storey homes, already completed and in use—highlighting the extent of high-end real estate development encroaching on fragile coastal ecosystems.

Collector’s Report Submitted to National Green Tribunal (NGT)

These violations came to light following an Action Taken Report submitted by Chengalpattu District Collector S Arunraj to the National Green Tribunal (NGT). The NGT had taken suo motu cognizance of the issue. A field team consisting of revenue and environmental department officials carried out GPS-tagged inspections to map illegal buildings and collect evidence.

Ownership records and photographic documentation were submitted to the Tamil Nadu State Coastal Zone Management Authority (TNSCZMA), paving the way for legal action. During the hearing, NGT Expert Member Satyagopal Korlapati questioned the delay in initiating demolition, emphasizing the urgency of restoring compliance in ecologically sensitive zones.

Why CRZ-III Compliance Matters for Buyers and Builders

The CRZ rules exist to protect coastal ecology, prevent soil erosion, and safeguard human lives from rising sea levels and extreme weather events. Structures built in violation of CRZ norms not only risk demolition but can also invalidate sale deeds, disqualify home loans, and result in financial losses for buyers.

Before investing in coastal properties, it’s essential to conduct thorough due diligence. Using Verified.RealEstate’s tools like the Land Use Zone Finder, CRZ Zone Check, and Due Diligence Services, buyers can verify whether a plot falls within restricted zones.

What This Means for Real Estate Along ECR

This development may lead to stricter CRZ enforcement across the entire ECR belt, a popular corridor for premium beachfront homes. Investors, builders, and buyers are now on high alert. Experts predict that regulatory oversight will increase, and unauthorized constructions near sensitive zones will be dealt with more stringently
