<h3 class="wp-block-heading"><strong>A Major Shift in Property Registration Law</strong></h3>



<p class="wp-block-paragraph">Tamil Nadu has officially tightened its property registration framework. With <strong>President Droupadi Murmu’s assent</strong>, a state amendment to the <strong>Registration Act, 1908</strong> through a state-specific modification, inserting <strong>Section 34-C</strong>, has come into force, making it <strong>mandatory to produce original title documents</strong> for registering any immovable property.</p>



<p class="wp-block-paragraph">This is not an advisory or guideline.<br>This is now <strong>law</strong>, effective <strong>from January 23, 2026</strong>.</p>



<p class="wp-block-paragraph">For property buyers, sellers, investors, and NRIs, this change directly impacts <strong>how property transactions are validated, accepted, and registered</strong> across Tamil Nadu.</p>



<h3 class="wp-block-heading"><strong>What Section 34-C Clearly States</strong></h3>



<p class="wp-block-paragraph">Section <strong>34-C</strong> begins with a <strong>non-obstante clause</strong> — meaning <strong>“notwithstanding anything contained in any other law”</strong>.</p>



<p class="wp-block-paragraph">In simple terms, this section overrides all earlier rules, circulars, and interpretations.</p>



<h4 class="wp-block-heading"><strong>Key Legal Requirement</strong></h4>



<p class="wp-block-paragraph">A document relating to immovable property <strong>shall not be registered</strong> unless:</p>



<ul class="wp-block-list">
<li>The <strong>executant produces the original document</strong> through which they acquired rights over the property</li>



<li>A <strong>valid Encumbrance Certificate (EC)</strong> for the same property, obtained <strong>within 10 days prior</strong> to submission for registration, is produced</li>
</ul>



<p class="wp-block-paragraph">Photocopies, reconstructed records, or explanations about “missing originals” no longer carry legal weight at the registration counter.</p>



<h3 class="wp-block-heading"><strong>Mandatory NOC for Mortgaged Properties</strong></h3>



<p class="wp-block-paragraph">Section 34-C also directly addresses a long-misused loophole.</p>



<h4 class="wp-block-heading"><strong>If a subsisting mortgage exists:</strong></h4>



<ul class="wp-block-list">
<li>The registering officer <strong>must refuse registration</strong></li>



<li>Registration can proceed <strong>only after a No Objection Certificate (NOC)</strong> is produced from the mortgagee (bank, financial institution, or lender)</li>
</ul>



<p class="wp-block-paragraph">This stops:</p>



<ul class="wp-block-list">
<li>Sale of mortgaged property without lender knowledge</li>



<li>Double sales using original deeds retained by banks</li>



<li>Fraudulent releases based on verbal assurances</li>
</ul>



<h3 class="wp-block-heading"><strong>What the New Law Mandates at Registration</strong></h3>



<p class="wp-block-paragraph">Under the amended Act, the following are now <strong>non-negotiable</strong>:</p>



<ul class="wp-block-list">
<li>Original ownership documents</li>



<li>Recent EC (issued within 10 days)</li>



<li>Mortgage NOC, where applicable</li>



<li>Clear linkage between title chain and EC entries</li>
</ul>



<p class="wp-block-paragraph">If any element fails verification, <strong>registration must be refused</strong>.</p>



<h3 class="wp-block-heading"><strong>Impact on Buyers, Sellers, and Investors</strong></h3>



<p class="wp-block-paragraph">This amendment significantly raises the compliance bar:</p>



<ul class="wp-block-list">
<li>Fake title chains become harder to push</li>



<li>Impersonation during registration is curtailed</li>



<li>Buyers gain protection <strong>before registration</strong>, not after litigation</li>



<li>NRIs and absentee owners get stronger statutory safeguards</li>
</ul>



<p class="wp-block-paragraph">At the same time, it exposes risky practices such as:</p>



<ul class="wp-block-list">
<li>“Originals with previous owner”</li>



<li>“Bank will give later”</li>



<li>“Court case is minor”</li>



<li>“EC will be updated after registration”</li>
</ul>



<p class="wp-block-paragraph">These excuses no longer work.</p>

<p class="wp-block-paragraph">This amendment doesn’t slow genuine transactions — it blocks fraudulent ones.</p>
