<h3 class="wp-block-heading"><strong>Landowners Win Against Builder After Five-Year Delay</strong></h3>



<p class="wp-block-paragraph">The <strong>Chennai North District Consumer Disputes Redressal Commission</strong> has ruled against <em>Bhoomi &amp; Buildings Pvt Ltd</em> for <em>deficiency in service</em> after an extreme delay in handing over flats developed under a joint-development agreement at Nungambakkam.</p>



<p class="wp-block-paragraph">The complainants—two landowners—had entrusted their property to the developer in <strong>April 2019</strong> under a contract that required completion within <strong>15 months</strong>, plus a <strong>3-month grace period</strong>. However, the builder handed over the completed flats only in <strong>June 2024</strong>, nearly <strong>five years later</strong>, far beyond the agreed timeline.</p>



<h3 class="wp-block-heading"><strong>Legal Notice Ignored Before Court Intervention</strong></h3>



<p class="wp-block-paragraph"> The <strong>joint landowners issued a legal notice</strong> to Bhoomi &amp; Buildings Pvt. Ltd., demanding compensation for the prolonged delay in handing over the constructed flats as per the terms of the joint development agreement, before approaching the court. Despite receiving the notice, the builder <strong>did not provide any response or settlement</strong>, which ultimately prompted the landowners to file a complaint before the <strong>Chennai (North) District Consumer Disputes Redressal Forum</strong>, leading to the current ruling in their favour.</p>



<h3 class="wp-block-heading">Covid Period &amp; Delay Adjustment</h3>

<p class="wp-block-paragraph">The builder defended the delay by stating that the <strong>title verification process</strong> had encountered complications which took nearly <strong>a year to resolve</strong>, thereby pushing the <em>effective handover date</em> of the property to <strong>October 1, 2019</strong>. The builder also argued its work was impacted by Covid. </p>



<p class="wp-block-paragraph">The Commission accepted that <strong>12 months</strong> due to the pandemic should be excluded. Accordingly, the “delay months” were reduced  to <strong>approximately 32 months</strong> .<br>Under the contract the builder had also agreed to compensate the landowners <strong>₹50,000 per month</strong> once the 18-month construction period expired until handing over.</p>



<h3 class="wp-block-heading">Commission’s Ruling</h3>



<p class="wp-block-paragraph">The arguments of both parties  were considered during the proceedings before the <strong>Chennai (North) District Consumer Disputes Redressal Forum</strong>. It was presided over by <strong>D. Gopinath</strong> with members <strong>Kavitha Kannan</strong> and <strong>V. Ramamurthy</strong>, who examined both the contractual obligations and the justification provided by the developer before delivering the verdict. They  found the builder had committed a <em>deficiency in service</em>. </p>



<p class="wp-block-paragraph">As per the order:</p>



<ul class="wp-block-list">
<li>The builder must pay <strong>₹8.50 lakh to each complainant</strong> as compensation for the delay in handing over the flats, <strong>as per the agreement</strong>.</li>



<li>This amount will carry <strong>9% interest per annum</strong>, calculated <strong>from the date of handover until the date of full realization</strong>.</li>



<li>The builder must also pay <strong>₹30,000 to each complainant</strong> towards, deficiency in service, monetary loss, mental agony and pain, litigation costs</li>



<li>All payments are to be made <strong>within two months from the date of the order</strong>.</li>

<h3 class="wp-block-heading">Why This Case Matters</h3>



<p class="wp-block-paragraph">This decision reiterates that:</p>



<ul class="wp-block-list">
<li>Even if Covid-related delays are considered, significant lag beyond contractual timelines can trigger compensation.</li>



<li>Compensation clauses in joint-development agreements (JDAs) are <strong>enforceable in consumer fora.</strong></li>



<li>Builders <strong>must account for both contractual timelines and external disruptions</strong> when structuring handovers.</li>
</ul>
