<p class="wp-block-paragraph">Renting out a house for a shop or office may bring better income. But before accepting a commercial tenant, owners need to check whether the property is approved for that use.</p>



<p class="wp-block-paragraph"><strong>Commercial use of residential property has come under fresh scrutiny following the Supreme Court’s order dated 22 September 2026.</strong> The Court directed authorities to prioritise action against commercial activity in areas designated and approved exclusively for residential use, including sealing premises found in violation.</p>



<p class="wp-block-paragraph">The proceedings began with an unauthorised building in Chennai. They have since grown into a wider examination of building violations and misuse of residential areas.</p>



<h2 class="wp-block-heading">The Loganathan Case: How It Started in Chennai</h2>



<p class="wp-block-paragraph">The case, <em>Loganathan v. State of Tamil Nadu</em>, concerned a property on Rajaji Street in Madhavaram, Chennai.</p>



<p class="wp-block-paragraph">A complainant raised concerns about unauthorised construction and the absence of a patta. The court records stated that Loganathan had constructed the building without obtaining building plan permission. Authorities issued enforcement notices, and the property was eventually locked and sealed.</p>



<p class="wp-block-paragraph">Loganathan approached the Madras High Court seeking to reopen the premises. The High Court dismissed his petition in February 2025 and directed authorities to implement the government’s orders and demolish the unauthorised portions.</p>



<p class="wp-block-paragraph">The dispute then reached the Supreme Court. The Court declined to interfere with the High Court’s decision. However, it questioned how a ground-plus-one building could come up without an approved plan and without timely intervention by officials. It directed the State to investigate the failure of enforcement.</p>



<h2 class="wp-block-heading">How One Building Dispute Became a Wider Inquiry</h2>



<p class="wp-block-paragraph">On 25 March 2026, the Supreme Court expanded the proceedings beyond the individual property.</p>



<p class="wp-block-paragraph">It observed that buildings were frequently constructed against the rules and later used for purposes different from those originally approved. It also expressed concern about residential colonies being turned into commercial areas through unauthorised use.</p>



<p class="wp-block-paragraph">The Court brought municipal bodies of State and Union Territory capitals into the proceedings. It directed them to identify areas reserved exclusively for residential use that were being used for other purposes and submit reports. Senior advocate Ajit Kumar Sinha was appointed to assist the Court.</p>



<h2 class="wp-block-heading">What the September Order Says</h2>



<p class="wp-block-paragraph">The <strong>22 September 2026 order</strong> sets out the following directions:</p>



<ul class="wp-block-list">
<li><strong>Residential-only areas:</strong> Where the area and permission are exclusively residential, commercial activity must be stopped, with offending premises sealed initially.</li>



<li><strong>Areas with unclear use:</strong> Authorities should maintain the existing situation for now while examining possible mixed use.</li>



<li><strong>Properties involved in disputes:</strong> A pending ownership or other dispute does not prevent sealing when the actual use violates the approved purpose.</li>



<li><strong>Buildings with no approval:</strong> Sealing or demolition should proceed as required by law.</li>
</ul>



<p class="wp-block-paragraph">The Court also warned authorities against selective enforcement.</p>



<h2 class="wp-block-heading">Earlier Protests in Meerut and Bhopal</h2>



<p class="wp-block-paragraph">The issue had already sparked protests in Meerut and Bhopal. In Meerut’s Shastri Nagar Central Market, authorities sealed 44 properties in April 2026 after Supreme Court directions against unauthorised commercial use of residential premises. Traders called a Meerut bandh on 9 April, and demolition proceedings followed in July. In Bhopal, a similar sealing drive in August triggered protests from traders, while some residents supported action against commercial activity in their neighbourhoods. Meerut’s dispute was a separate case, while Bhopal’s action was connected to the wider such proceedings.</p>



<h2 class="wp-block-heading">What Owners and Tenants Should Check</h2>



<p class="wp-block-paragraph">The practical lesson is to <strong>verify the approved use before buying, renting or converting a property for business</strong>.</p>



<p class="wp-block-paragraph">Start with these questions:</p>



<ul class="wp-block-list">
<li>What use is permitted under the applicable land-use plan?</li>



<li>What purpose is recorded in the sanctioned building plan?</li>



<li>Does any later approval permit a change of use?</li>

<p class="wp-block-paragraph">Planning to build near a Chennai Metro line? Your proposal may need a <strong>No Objection Certificate (NOC) from Chennai Metro Rail Limited (CMRL)</strong>. The requirement depends on whether the metro corridor is completed or under development, where the property lies, and what construction work is proposed. CMRL uses the NOC process to protect existing metro structures and planned alignments. </p>



<h3 class="wp-block-heading">When is a CMRL NOC required?</h3>



<p class="wp-block-paragraph">CMRL defines a <strong>Metro Protection Zone</strong> around its corridors. A development or construction proposal within this zone must be referred to CMRL for an NOC through the relevant approval authority.</p>

<p class="wp-block-paragraph">For a completed corridor, measure from the <strong>edge of the metro structure</strong>. For a proposed or under-construction corridor, measure from the <strong>centreline of the alignment</strong>. The policy uses different reference points, so distance from the nearest track alone may give the wrong answer. </p>



<h3 class="wp-block-heading">Rules near a completed underground metro corridor</h3>



<p class="wp-block-paragraph">The underground protection zone has two parts:</p>



<ul class="wp-block-list">
<li><strong>Zone I:</strong> The area above the underground structure, plus 3.5 m beyond each edge.</li>



<li><strong>Zone II:</strong> The next 7.5 m on each side.</li>
</ul>



<p class="wp-block-paragraph">In <strong>Zone I</strong>, deep or pile foundations, ground anchors, borewells, boreholes and blasting are prohibited. Basement excavation, utility work and underground passageways are restricted and require CMRL’s technical consideration. Where development falls in Zone I, the policy also sets a maximum allowable pressure of <strong>60 kPa at the tunnel top</strong>.</p>



<p class="wp-block-paragraph">In <strong>Zone II</strong>, excavation, borewells and boreholes are restricted. Proposed pile foundations must meet the policy’s debonding requirement.</p>



<h3 class="wp-block-heading">Rules near a completed elevated metro corridor</h3>



<p class="wp-block-paragraph">For elevated and at-grade structures, <strong>Zone I</strong> extends 2 m from the structure’s edge. <strong>Zone II</strong> covers the next 3 m.</p>



<p class="wp-block-paragraph">CMRL prohibits construction, excavation, crane operation, scaffolding, utility work, storage of goods and explosives in <strong>Zone I</strong>. In <strong>Zone II</strong>, activities such as utility work, anchor drilling and work involving vibration are restricted. CMRL may permit a restricted activity only after reviewing its safety implications. </p>



<h3 class="wp-block-heading">What about proposed or under-construction metro lines?</h3>



<p class="wp-block-paragraph">For these corridors, the protection zone extends <strong>50 m on either side of the proposed alignment’s centreline</strong>, whether the planned metro section is underground or elevated. A property within that distance is subject to CMRL review when development or construction is proposed. Being within the zone does <strong>not</strong>, by itself, mean the land will be acquired or that construction will automatically be refused. The exact alignment and proposal must be checked. </p>



<h3 class="wp-block-heading">Does an existing building need a CMRL NOC?</h3>



<p class="wp-block-paragraph">The policy deals with <strong>development and construction proposals</strong>. It does not state that an owner needs a retrospective NOC simply because an existing building stands near a metro line. If the owner later proposes an extension, redevelopment, basement or other construction, the new proposal may require CMRL review. Land acquisition, if proposed for that property, is a separate matter to check.</p>



<h3 class="wp-block-heading">How do you apply for the CMRL NOC?</h3>



<p class="wp-block-paragraph">The approval authority—such as CMDA, GCC or another local body—forwards the application to CMRL directly or through the Single Window Portal. The submission must include a land plan, a design report covering the foundation and base-pressure calculations, structural drawings and relevant supporting documents.</p>



<p class="wp-block-paragraph">CMRL verifies the site against its alignment, checks any land acquisition issue, and conducts a structural review. It then issues the NOC or communicates a rejection through the approval authority. The policy sets a <strong>30-day reply period from receipt of all necessary documents</strong>. </p>



<h3 class="wp-block-heading">Is a CMRL NOC needed for land regularisation or reclassification?</h3>



<p class="wp-block-paragraph"><strong>No.</strong> The policy expressly says a CMRL NOC is not required for land regularisation or reclassification, even if the property is within the Metro Protection Zone. This exception concerns the CMRL NOC; the applicant must still follow the applicable process for regularisation or reclassification.</p>



<p class="wp-block-paragraph">Before preparing building plans near a metro corridor, establish the <strong>status and exact location of the alignment</strong>. That determines the applicable protection zone and whether the proposal must go to CMRL.</p>

However, the commission’s members, powers, procedure and formation date have not yet been officially detailed.</p>



<h2 class="wp-block-heading">What is Panchami land?</h2>



<p class="wp-block-paragraph">Panchami lands were assigned to members of the <strong>Depressed Classes—now referred to as Scheduled Castes</strong>—during the British period to protect them from landlessness and exploitation.</p>



<p class="wp-block-paragraph">In the <em>V.G.P. Prem Nagar</em> case, the Madras High Court <strong>discussed the conditions</strong> applicable to such assignments.</p>



<ul class="wp-block-list">
<li>Under the relevant Special Form-D condition, the assigned land could not be sold, gifted, mortgaged or leased during the first ten years.</li>

<p class="wp-block-paragraph">The latest sale deed, patta or Encumbrance Certificate may show a continuous chain of transactions without clearly revealing that the land was originally assigned with transfer restrictions.</p>



<p class="wp-block-paragraph">A registered sale deed or a patta in the seller’s name does not automatically prove that an earlier transfer was legally valid. A buyer may discover the Panchami-land issue only after paying an advance, purchasing the property or applying for building approval.</p>
