To fully understand how these rules work in the real world, we must look at how Indian courts—including the Supreme Court of India and state High Courts—have decided real disputes between landlords and Pagdi tenants.

In this final part of our series, we examine key court rulings that shaped tenancy rights, inheritance laws, and eviction rules in simple English.

Inheritance: Who Gets the Tenancy Rights When a Tenant Dies?

One of the most common court disputes happens when an original Pagdi tenant dies and the landlord tries to take back the shop, claiming the tenancy has ended.

Landmark Case: Suresh Kumar Kohli v. Rakesh Jain (Supreme Court of India, 2018)

  • The Story: When the original statutory tenant of a commercial shop died, one of his sons continued running the business. The landlord tried to evict the family, arguing that the tenancy ended automatically with the father’s death.
  • What the Court Decided: The Supreme Court ruled that when an original tenant passes away, the tenancy rights pass to all legal heirs together as “joint tenants” (multiple people holding the same inherited tenancy rights as a single group).
  • The Simple Rule: A landlord cannot automatically take back a shop simply because the main tenant died. As long as family members were actively working or living there with the tenant, they share protected joint tenancy rights under the law.

Transferring Goodwill and Tenancy Rights Without Permission

Landlords often file court cases when a tenant transfers or sells their shop running-rights to a new buyer without getting written permission first.

Landmark Case: Shivalingappa v. M.C. Eranna (Supreme Court of India)

  • The Story: A long-term tenant of a commercial space collected a large lump sum (“goodwill”) from a new buyer and handed over the physical shop keys and operations without taking written permission from the building owner.
  • What the Court Decided: The court ruled that transferring physical possession or selling running-rights to a third party without the landlord’s written consent is unauthorized sub-letting (renting or transferring property to someone else without the owner’s permission).
  • The Simple Rule: Even if taking “goodwill” money is common local practice, passing shop keys to a new buyer behind the owner’s back gives the landlord a direct legal right to evict both the old and new tenant.

Landlord Claiming “Personal Business Need” (Bona Fide Requirement)

Landlords who want to get their property back from a Pagdi tenant often claim they need the shop for their own personal use or business.

Landmark Case: Prativa Devi v. T.V. Krishnan (Supreme Court of India)

  • The Story: An elderly landlady wanted her property back to live in and use, but the long-term tenant refused to leave, claiming she could easily stay elsewhere or live with relatives.
  • What the Court Decided: The Supreme Court established the principle that the landlord is the best judge of their own need. A tenant cannot force the owner to live elsewhere or tell them how to manage their life.
  • The Simple Rule: A landlord can get their property back if their need is bona fide (a genuine, honest, and real requirement). However, if the tenant proves the owner already has other vacant shops nearby, courts will dismiss the landlord’s request as a trick for higher rent.

Modern Trends and Local Precedents in Tamil Nadu

Under Tamil Nadu’s tenancy framework, courts evaluate landlord needs and modern registration standards strictly based on present facts.

Local Practice Precedent: D. Sasi Kumar v. Soundararajan (Supreme Court / Tamil Nadu Courts)

  • The Story: A landlord in Tamil Nadu filed for eviction claiming he needed his commercial shop space to start a garment business. The tenant argued that the landlord was making up the story just to hike the monthly rent.
  • What the Court Decided: The court held that the genuine need must be judged on the exact date the eviction case is filed. The landlord does not need to show prior experience in the new business, only the financial ability and real intention to start it.
  • The Simple Rule: Under Tamil Nadu tenancy laws, an owner can reclaim their space for a new venture as long as they can prove to the Rent Court that they have a real plan and the financial means to carry it out.

Conclusion of the 3-Part Series

Navigating a Pagdi or heavy-deposit property requires balancing historical customs with modern property laws:

  • Part 1 showed us how quasi-ownership and customary splits work on the ground in Chennai and Tamil Nadu trading hubs.
  • Part 2 explained the legal framework, tenancy inheritance, goodwill transfers, and statutory grounds for eviction.
  • Part 3 demonstrated how courts protect genuine tenants while giving landlords clear legal paths when rules are broken.
